Bill higher than my plan? What can i do?

Some advice please.

ok, last wednesday i got a contract phone from phones 4 u for a samsung galaxy s, which has a monthly contract of £35 a month.This was as much as i can afford and was clear to the sales person i could not afford any higher. Got a bill today saying it will be £38.50? I have not used any of my allowances up or been charged extras for anything else.

VAT at Std Rate on £32.77 £5.73

Total for this bill £38.50

This has made me extemely peed off.:mad: I know its only £3.50 but its the principal.
I have a signed agreement that says £35 monthly charge incl. Vat

however: on thier refunds and exchanges note it says:

Please note that Phones 4u does not operate a 14 day cooling off period. This does not affact your statuary rights.

My question is Can I take it back?

    First bills are always a bit more because as you fit into the billing cycle you normally pay for a month and a bit. In your case instead of paying line rental from the 8th of Sept to the 7th of Oct, you've paid until the 10th Oct which is about 1/10 of a month more - which is where the £3 comes from. Future bills will be for exactly a month so will only be £35.

  • You've agreed to pay £35 a month and the first bill is for more than a month. This is what happens on all monthly mobile contracts.
  • That first bill is for 33 days NOT for a month. It states quite clearly that the inclusive dates are the 8th of September to the 10th of October. Divide £35 by 30 then multiply by 33 and you get... £38.50.
