Private Land Parking Ticket

I am slightly confused at what I should be doing so some advice would be greatly appreciated please.

My family recently visited a retail park where there is a restaurant and stores in one car park and over the road (same retail park) there is a supermarket with another car park.

We went for something to eat in the restaurant and as we have a new born child I fed her in the restaurant which can take a while as any parent will know. Once we had finished in there we went into one of the stores and when we came out I had to feed my baby again which I did in the car. When I had finished feeding we decided to get a bit of shopping from the supermarket just across the road so rather than putting our baby back in the car then having to get them out again we thought we would walk over to the store and didn't think anything of it.

A couple of weeks later we received a parking fine through the door stating we had over stayed our welcome and that we were to pay a £65 within 14 days and if not received within 28 days it would be £150.

After looking on this site we decided not to pay it as it mentions in hope they will go away! But we have now received a second invoice/letter telling us to pay £150 within the next 7 days or they will issue a court summons and possibly receive a bailiffs visit!

I have just re-read the advice on here and I am not sure if I am to ignore the invoice once again, write to them to say I am not paying or what to do.

Can some please tell me the best thing to do in plain english.

Thank you

If you're certain that it is a private ticket (and not a council/police one) then keep ignoring everything they send. You may receive a few more letters and they are all designed to scare you into paying.

Even if they did decide to "make an example" of you and take you to court (which they won't) the judge would almost certainly throw out their claim anyway, because they won't be able to provide any proof that you agreed to the parking contract.

Thank you. I would assume if it was the council or police they would have headed paper stating this - correct!?! This particular document states nothing of the sort. Is it worth phoning the restuarant up to check do you think?

Its a scam, don't pay them anything at all, and ignore their pleas for your money, basically its a free car park, you were shopping there, so there is no loss to the landowner, if they took you to court they would have to prove the loss, which they can't!!

    A quick guide on tickets;

Penalty charge notice (PCN) = issued from a council, don't ignore as its enforceable, come here for advice.

Parking charge notice (FAKE pcn ) = completely and utterly ignore, the ticket is NOT enforceable and should not be paid or appealed.
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

If it is council or police they will have the council or police logo on the ticket .

It is probably a management company for example excel parking.

Dont pay it , ignore all communication , dont even phone them . Just sit back till they get bored .

I have just searched the company on the internet and it is a company hired by the landowners I believe called Traffic Guard. So can they issue a county court judgement, a possible warrant to bailiffs and can it affect my credit?

No they can't just issue a CCJ. It has to go to court where a judge decides the case. If you lose and you don't pay whatever the judge orders then a CCJ is issued by the court, and NOT by the parking company. As this is very, very, unlikely I shouldn't worry about it.

You are taking this too seriously, they will not take you to court, you got more chance of winning the jackpot on the lottery tonight than that happening.

  • I wouldn't say I am panicking really, just wanted to make sure I am doing the right thing. The last thing I want is to be taken to court or bailiffs knocking at my door especially as I have a 2 year old and an 8 week old child. Thanks for all of your help and advice.
