I lost my friend an iPhone :(

I feel really guilty talking about this...

I decided to creep up behind a friend and scare her, leading her to jump and drop her iphone into the sea (we were at a pier and she was looking into the sea)

Now shes tried to report the incident to her insurance company who recommended her to report the phone lost as she would be unable to retreive the phone from the sea but they have declined her claim and now i feel bad.

Can she not appeal this?

I am thnking of asking her if she would accept half of the money to replace it for a new one.

    The way I understand it is this: If you actually "lose" your phone (by leaving it on a bus, etc) and it doesn't get handed in anywhere, then someone will have taken (stolen) it. This is why you report it to the police as lost, get a ref number, and assuming it doesn't get handed in, then the insurance company have to treat it as stolen so they will pay up.

    By being honest and saying it fell into the sea you have accepted blame for it. You aren't a victim of a dishonest person finding and keeping your phone, so the insurance won't pay up.

  • I suspect that the issue is that you don't have a phone to return as would be the case if it had smashed on the floor, nor do you have a crime number from the police for reporting it stolen. I guess they are concerned that they are being scammed for a second 'free' phone (considering that there may be people who can return a locked phone to working order.)

    You can always appeal against their decision but be prepared for each next level of appeal to say no as well.

    Well i offered to give a statement if things went that far, and she was told by the advisors that it would be best to report the phone as lost so she did just that, she was also told to get the phone blocked and send in evidence of that, and she did that too, so no one could use the phone if some super genius managed to get the phone out of the water and get it working again.

    They did not even give her a reason so she doesnt not know what grounds to appeal on.

    Shes reluctant to take the money from me because she said that it could have been me who dropped my phone as she would have most probably taken the opportunity to scare me too.

    There are only 2 valid reasons for your friend's claim being declined:

    1. The phone needed to be specified on the policy and wasn't
    2. Your friend does not have "away from home" or "personal possessions" cover (same thing - different names)

    When an insurance company declines a claim, they should provide you with details of why, not just say "I'm sorry but we're declining your claim". Your friend needs to investigate this a bit more, but after that you should feel free to PM me if they give you any reason other than the above 2. I work in the insurance industry and would be happy to help.

    Depends on the policy. Many don't and I was assuming it didn't here.
