    One more thing Misty , dont sign the letter , just print the name and send the letter " signed for " . ( keep copies)

    Keep us posted , but remember as DVardy has said , they are trying it on in the hope that you will just cough up the money without a fuss.:)

    Mistys, I often see around the net, "pictures, or it never happened." In this case, proof or it never happened (that's on the solicitor's part, not yours!).

    I'm sorry but the letter is absolute rubbish (like the phone call from the call centre monkey!). You're trying to 'scare' the solicitors with legalese, and it won't work. Particularly the nonsense about Data Protection.

    hudsonj and booter have it right - keep it short and simple, and stick to what you know. You don't know the law, but you do know the facts.

    eg:

    Dear Sirs,

    Re: Hutchinson 3G - ************(todays telephone conversation)

    There is no debt on the account.

    All debts owing on this account were settled in October 2003. You confirmed in our phone conversation that you are unable to provide proof of any debt.

    Any further correspondence on this matter should be conducted in writing. Please do not contact me or my husband by telephone again.



    If they do call you, /then/ you should mention - but I suggest don't quote from - Limitation Act and what have you (but not DPA!)

    Hiya - I still think you should keep it short and sweet. Let them do all the work, (if they can be ar**d). The mention of the Admin of Justice Act is just to let them know that you consider it harassment if they persist. But reference to any other legislation may get them digging deeper to try and prove you wrong! They probably won't bother reading a longer letter anyway (I suspect they may be semi-illiterate that's why they resort to phone calls). I would never ask anyone to confirm a debt as being written off - you're giving them a reason to get back to you, in whichever way they see fit. The short letter basically tells them to "put up or shut up".

    This is perfect, short and sweet.

    These debt companies scare the life out of people to get them to own up and pay.

    They have done part one of their job which is to scare the life out of you the next bit they will think is easy, luckily you came here first.

    If they can't prove how much you allegedly owe, how is it going to look in court, ccj that's just to scare you, it won't happen.

    i rang national debtline earlier today who have advised me to send the letter which i quoted earlier.
    so i will be sending this tomorrow :)
