Dear all

After reading about the scam for parking fines I have sent the following to Michael Sobell direct after speaking with the man himself earlier today. Q? Should I add anything to this (wish I asked b4) your comments and advice is appreciated?
Dear Michael
Thank you for your voicemail dated 13:12 14th September 2010 and subsequent phone call we had a few a few moments later.
For your reference from your most recent letter of I believe 4 sent to date you have an account reference of and legal reference .
Since our discussion I have checked 2 things the video evidence of ticket process on the machine I used at Bristol Parkway train station and a further discussion with my employers legal team and have decided the following:
I have a valid defence to your claim and I am confident that any court action taken will be in this instance a successful defence in my favour.
I am happy to pay the fine should a court find it withholding and therefore wish for the next action and the next action only to be your firm sending through details of a court date. I do not wish to see any correspondence from debt collectors or alike, please also note I do except any of your charges added to the fine as they are in no way legal.
I look forward to receiving a court date from you in the near future.
Kind Regards
Gari

If this is s private parking ticket I would remove the word "fine" from the letter, and substitute "invoice". To call it a fine gives it the legitimacy it doesn't deserve.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

Damn. I wish I hadn't skipped my English classes at school - I'd love to have written a grammatically correct letter such as that!

It doesn't really matter - even accidentally calling it a fine does not magically make it legitimate and will not result on a PPC's success in court.

The OP spoke to Michael Sobell, a retired Solicitor who lends his 'Graham White Solicitors' name to Roxburghe? Really?

OP are you SURE? Roxburghe staff pass themselves off as Graham White you know, there is no actual solicitor involved in these private tickets where Roxburghe handle the [STRIKE]debt-collecting[/STRIKE] extortion attempt. It's just Roxburghe staff and they are powerless.

Still, no harm done in writing the letter as they never do Court.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If any of his 'staff' have attempted to hold themselves out as solicitors (i.e. Mr Sobell) when not entitled to do so I would suggest the OP reports what is potentially a criminal offence:

Wow thats like a refined version of the one I wrote to Parking Eye who wrote back once only to ask for further evidence.

Except when they have to answer to a ccj, or injunction or criminal trial
    If it moves; sue it!
  • Hi all,

I spoke with the call centre/office on the Monday and said I only wish to speak with M Sobell or his PA and he called me back the following day (very posh sounding chap). He did not leave a number on my voicemail though which is a shame as I could pass it on to other, I used the call back facility 55 in the voicemail menu. Thanks for the comments to date.

LPK023 - why are you calling them and sending them letters (and giving them your mobile phone number!) ???
The advice given on these boards is to ignore all communications from these private parking companies, unless you have received what you believe to be a court summons, and then you check directly with the court to determine whether the court summons is genuine or nor.
