    I don't need help with the MOT I need help with the legal aspects can you help with that? If not go away.

    Stop making it a major drama and ask them nicely if they can fix it and arrange to MOT it it...perhaps offer to pay for the MOT? You really should have asked for 12 months MOT up front as part of the deal.

    Yes you did! You said according to your MOT certificate you can't MOT a car until 28 days before your current one expires...which is/was clearly wrong! You've now amended your post to say something totally different! You can MOT a car every day of it's life if you choose to!

  • I'm really embarrassed! I told my partner to post on this site thinking he would get some usefull information with legal advise and instead he gets a couple of idiots who think they are clever! No advise is needed in regards to MOT's or getting the car fixed as the garage are NOT INTERESTED in helping as clearly stated in original post!

    Queen you will know for the future that usually when you buy a car from a trader and quite often privately too that part of the haggling process involves having 12 months MOT. If you had been aware of that then the problem with the exhaust would have been covered by this MOT and fixed.

    As it was, you did not insist on a new MOT as part of your deal and therefore I don't think you have any cause for recompense. You have been naive and should just get the exhaust dealt with and move on.

    If there are no other problems with the MOT then the guy selling it to you wasn't actually far wrong in what he said.

    Why not mention what the car is? Make/Model Engine type and size?

    Some cars have known problems, It could be a simple problem like a temperature sensor.
    Giving a false reading saying the engine is cold so overfuels
    just as it would on a cold frosty morning.

    No other readings from the MOT? Lambda sensors?

    Has it ever been serviced?

    The car was bought from a trader, so you do have rights, but we are missing a lot of information here.

    What exactly did the description of the car say? Did it say it was in good running order with no known faults. The long route would be to write a "letter before action" to the trader, requesting that the fix the issue (and pay for the failed MOT), and threaten to take them to court if they fail to do this. You would have to prove that they knew the car was faulty.

    The best route is to put it down to experience and just get it fixed, as proving the garage to by lying might be difficult, although it depends what the advert said! To be honest, the garage who did the MOT sound a little vague!! Surely they must know WHERE it's failing. Mine failed emissions the other year, and just required a new CAT, which my OH fitted easily. It wasn't expensive. If it's leaking into the car somewhere, then surely the garage must be able to find a leak somewhere?? There's only so many places an exhaust can leak... (and it also implies there might be a hole in the car!)
