Faulty LG Arena, half way through contract
Hi, I have an LG Arena-not my first choice of phone but it was recommended by my phone provider ( t-mobile) as the one I wanted had been discontinued. Since having it I've had problems. (screen freezes, switches itself off, battery drains-even when switched off, difficulty switching it on when not plugged into the mains, answer key doesn't always work-I end up having to call people back-costing me more...)It's been returned twice to be repaired and I'm REALLY getting fed up with losing data each time and having to re-organise/re-enter data in my phonebook and dictionary. Not to mention being left with a low quality phone for two weeks whilst it's in the repair shop. ( I should mention, the second time they took it in for repair they gave me a complimentary pay-as-you-go phone, to 'keep the customer') I've asked for a replacement but this phone has also now been discontinued. I've asked to therefore to be released from my contract as they cannot come to a satisfactory conclusion. Their reply is that this is not possible. Is that right? Am I to expect to send my phone off every few weeks for repair and accept that as normal?:mad:

Have you tried sending it to LG to be looked at?
A mobile contract is really two contracts one for the phone hardware and one for airtime, Faiults in the phone does not give you the right to cancel the airtime contract.0 -

t-mobile have taken the phone back twice to be repaired, while some faults were corrected-others weren't...As they can't replace the phone with like-for-like, what can I expect?0 -
1. How long have you had the contract? Certainly a phone should last the term of the contract under reasonable use.
2. You can't cancel the air time, as said above, but you have the right under SOGA for a handset of merchandisable quality. Read up on the web on SOGA and mobile phones.
3. Read T-Mobile's t&c and see what they promise to do with faulty handsets. Certainly, giving them 3 chances over a few months to put it right shows you behaving reasonably. They now need to be told in a Letter before Action (LBA) that you are dissatisfied with their attempts to repair the phone and, under the Sale Of Goods Act, you are demanding a suitable replacement. Failing that, you will have no choice but to seek recompense through the small claims court.
Now all that depends upon question 1 and also your ability to prove how many times they have had chances to repair the phone.
The sad fact is that many phones have inherent faults and some are not robust enough for every day use. That is the manufacturer's prime fault, but, of course, they did not make the contract with you.0 -
mines gone back to the first problam i had was the bottom part of the screen was replaced. then had to take it back yesterday as it wouldnt charge or switch on so 6 months on its gone back yet again for repair. have u thought after 3 repairs if they dont replace it claim on your insurance and ask them for a differnt phone0
