Accident - 3rd party denying liabilty - Car was parked !!!!!

Cant believe this....
Wife was in the hair salon one day with car parked outside. Other people saw this young girl, on her mobile, come barreling down the road and ram into the back on her car.
Anyway, got the details, her fathers car she was named driver, rang the insurance. They said because it was obviously not my fault no excess to pay, so got car fixed.
Now they are saying the 3rd party is denying liability and they're going to have to start legal proceedings. Cant believe it. How can they deny liability if the car was parked?
I can smell a stitch up here. We've got plenty of witnesses who can verify that the car was parked up when the accident happened but I'm just wondering if they're going to come up with a completely different story and some 'made up' witnesses? :-(

Even if the car wasn't park they still went in the back of you so it's still a no contestNothing to see here, move along.0

I think that they are just trying it on, just make sure that you do have your witness statements (more than one) and also speak to your insurance company as ask they to claim for your stress and worry over this matter.
If you do have a witness to this accident then make sure it is reported to the Police that she run into your car whilst on a mobile phone.0 -
just to add if Daddies little girl was driving the car and she told Daddy that the nasty driverless car started itself, engaged reverse gear and rammed into her then he most probably believed her ;o)))))0

most people have a camera on their mobile phone, if you are caught in an accident regardless of blame you should take as many photo's of the cars and damage as possible for future encounters0

Hasn't this already been discussed (to death)? This is the fourth thread you have in this forum about this!
First in June you told us your car was being written off after the incident, but wanted to keep it on the road, when eventually the insurer agreed to repair it:

As an incredibly similar incident happened to me this weekend, I suggest that lying about insurance claims should be taken up by the police as fraud. After all, property damage has been done and money will be exchanged, in some cases wrongly, so why the "leave it to the insurers" nonsense?0

Yeh. Planning to round up witness now just in case.
Probably a bit late to tell the police about the mobile phone now. Wish I had now.
At the time, young girl burst into tears and begged wife not to tell her dad she was on the phone. Stupidly, me and the wife fell for that because didnt think it was relevant - she went into the back of a parked car for whatever reason.
Lesson learnt....0 -

Go back to the Police and get your wife to make a statement to that affect as they can check her phone records, I would also contact her father if you have his details.0
