T-mobile what rights do i have?

I renewed my T-mobile contract on the 19th August and received a new Sony Ericsson Experia. I received the phone the following day and really liked the phone. The phone has now started playing up from today, battery not holding charge, unable to receive/make phone calls even when i have full signal, functions I was told the phone would have but I have now found the phone doesn't have (miss sold).
I have contacted T-mobile customer services and was told to go to a local store and they will advise if they can change the phone or send for repair. Went to store unable to help as i renewed my contract over the phone and received phone via post I had to deal with T-mobile over the phone!!
Contacted customer services again they are totally unable to help me! I have to arrange for the phone to be sent back and repaired, i dont want a repaired phone incase it does the same thing again! I will also have to pay for a hire phone!!!!
I signed up to a 24 month contract on the 19th August, my contract states I have 7 days to return the phone if i am not happy. I am getting no joy from customer services, I was promised a manager would call me back I have never received the call which is totally unacceptable.
Any help, advice would be greatful.

    You are well outside the cooling off period of 7 days, so you have to give them the opportunity to repair the phone first. If that can't be done then they need to offer you a replacement or an alternative handset of equal or better value.
    You haven't actually said what resolution you are seeking to this issue, if you are hoping to cancel your airtime contract then you are going to be disappointed, as they won't do it.
    No free lunch, and no free laptop ;)
  • Thanks for the reply, all i want is a phone that works properly! they have said to me they have 2 chances to repair the phone then they will replace. I take it i have to go this way and not pursue for a replacement?

    Yes you do, there is no automatic right to a replacement with any consumer goods.
    No free lunch, and no free laptop ;)

    I think within 28 days of sale you are entitled to a replacement mobile of brand new sort of thing....aim ur guns and stand ur ground.
  • phones 4u and voda etc have a 28 day policy. it isn't fit for purpose. tell them you want a replacement - not even a month old x
