Can I cancel my contract on this basis?
I signed up to a contract at The Carphone Warehouse believing I would be receiving 1GB of internet usage with my allowances. After receiving only 500mb I went into the store and asked for the issue to be resolved. The sales assistant called the network provider, and was apparently informed that I would now be getting a full 1Gb.
After my allowances refreshed for the month I was still only receiving 500mb. I have consequently being phoning CPW, who firstly failed to return my calls several times, then proceeded to blame the network provider, then tried to sell me additional addons.
I now wish to cancel my contract as I have been continuously misled. I have proof in writing of the 1gb allowance I was supposed to receive, is this enough of a basis to forfeit the contract? I no longer want the extra data, I don't wish to business with this company any longer!

Doubt whether they will accept this cancellation if there has just been a mistake which they can rectify.
However, if you have been missold by CPW, then you may have grounds to either sue them for the extra cost (assuming they don't just reimburse you) or get your contract cancelled. (Are CPW the network provider too? If not, get the network on your side as they don't like any misselling like this by their agents)0 -

The network provider is 3, but is it not CPW I have to deal with as they are agents acting on behalf of 3?0

Have you been charged for going over 500mb?
If you have, CPW simply need to ensure such charges are either cancelled or met by CPW themselves, up to a 1 GB limit.
I doubt you can drop the contract on this basis as they can readily rectify it.0 -
You definitely want to get them to confirm the 1gb limit IN WRITING - if they refuse to do this then i'd say they would have breached the contract.0

Any breach has nothing to do with them putting it in writing. The OP says they have proof - that is what the writing is about.0

The network provider (3) tell the CPW what they can offer. CPW do not decide what the tariffs are.Estate Agent, Web Designer & All Round Geek!0

I phoned 3 and they gave me a 2GB addon on top of what I'm already getting, free of charge, no fuss, no hassle
