If you contact a good personal injury solicitor (try contacting the law society or go on lawsociety.org) they could bring a claim for injury for the children and/or yourself. This would be linked to a claim for housing disrepair to get a Court order to repair the property or pay you the money to get the repairs done.
Basically your solicitor will send a surveyor then write a letter of claim then start a court case if no suitable response is made in 4 weeks. These rules are in the housing disrepair pre action protocol on the MOJ website look on google for civil procedure rules and then choose the pre action protocols to find the housing disrepair protocol.
Even if you are moved out there should be no difficulty getting the damages off the landlord as long as they do have money/equity in the property.0 -

the EHO told me that she has only ever served a notice once on a visit which required the tenant to vacate immediately.
As far as the hazards are concerned i think the EHO do the classing based on 12 months more with the hazard present and what result of the hazard would be on individuals. for example the low windows on the top floor which are loose are class one- if a child were to fall from the window the likelihood is death.
Im as confused as everyone else. If the walls are as sodden as the EHO says (the damp meter reading was off the scale for all walls she tested) why are they continuing to let us live there
I agree with this. I dont have the answer to this question for you Im afraid.Its not clear from what you have said whether a) that wimdow can be repaired and minimise class 1 hazard. The damp may cause you significant health problems, but not likely to be death? I dont know im typing out loudWill check my notes in the morning and come back to you.

Housing options depending where you live may offer you a HA flat, a council property or the option to move into other rented accommodation that is accredited or vetted by the council.
They may have a deposit scheme.

yeah we have a protected deposit but as we are all joint tenants this is split in half for my partner and i's share.
I have phoned up this morning and said i am not waiting until next week to have a housing options meeting. Woke up this morning, pram covered in mould. So far hundreds of pounds of toys and swings,walkers have been ruined.

no response yet waited all day for them to call- nothing. what annoys me is they tell me the EHO is away yet i go down to the council office and shes in there! and they wont give me a medical form relating to housing application because i dont have my id with me, she was in the house 2 days ago!!Even a stopped clock tells the right time twice a day, and for once I'm inclined to believe Withnail is right. just an update... i have finally got through to the housing options people. they said they have spoken to the EHO and because the EHO has given us a 'medium' state of disrepair they are unwilling to help try to house us?madness.
