Tesc0 Finance Problem and a whole bunch of useful contacts

I was looking for a postcode for the T.esc0 customer complaint's team as they gave me the wrong one on the phone (I think it may have been the person I was talking to's home one!) anyway I found this ;

moneyscotland.gov.uk/das/files/Creditor_contact_new_2.xls

A whole bunch of creditors contact details - not sure who/why they are creditors but basically it's a whole load of finance houses contact details, complaints teams, phone numbers direct emails and names...

Yeah, nice eh? Thanks Money Scotland, nice way of protecting that data... Anyway it's there, I also have a local save so if you need it and it disappears then I'll happily share.

Here's why I needed that info... Long story as short as I can make it;
My wife took out a personal loan with T.esc0 Pers0nal Finance. 1yr 0% interest to start with. We intended to pay it all off before then with a house sale, well... Credit crunch etc. etc. eventually nearly 2 years later we sell house and move and don't have it all to pay off the loan. During this time we both lose our jobs, as we were going through our finances I spot on my wife's loan a PPI charge, hmmm. So although it wasn't wanted we thought we'd claim as we were both out of work. OK well this is where it gets interesting. T.esc0/Insurance Co. refuse to pay out as the DWP have a JSA claim with us both on it in MY name and the loan is in HER name and thus the PPI doesn't cover the situation. My wife remember being told when she was sold it at the time "what about if your husband loses his job" now my wife is not given to flights of fancy so we point this out plus give them a letter from the DWP stating that family claims are always in the main breadwinners name, namely ME. So there's no way my wife can get a claim wiith her name on it. Thus stalemate.

FFW nearly 20 months. T.esc0 wouldn't respond after intial discussions with RBS who had white labelled the loan for T.esc0. But then nothing. We get an offer of a few hundred quid but no admission of wrongdoing, no liability and no refund on the PPI. We refuse it as we point out that if we can't use something why were we sold it and why would we CONTINUE to pay for it knowing that we can't use it? No reply to that.

We then get threatening debt agency letters, try talking to them but they want the whole lot (well over 10K inc. the PPI we can't claim on). We then prove with the National Debt Helpline's help (gotta love those guys) that we are suffering financial distress. They iognore that and send us a solicitors letter.

We speak to solicitor and explain the situation and they go away never to be heard from again. We then don't hear ANYTHING from either T.esc0, Debt Agency or anyone for well over 9 motnhs then out the blue we get a statement from T.esc0. Swiftly followed by lots of letter from the Debt Agency, we try to talk sense to them but they want the lot or payments in BIG chunks. So we go to the Ombudsman 10 months ago and they keep sending us "you're in queue" type letters and eventually we get an Ombudsman assigned to our case. He interviews us over the phone all is good, but still no adjudication. Basically we're in limbo. He has told us that he has made his finally decision but won't tell us due to "other factors" that he is looking into as to why we can;t claim. My feeling is he's going to say it was sold legally and thus we have to pay but my argument is going to be well if it was sold legally why can't we claim?

So there it is we sit and await judgement, still unable to pay anything and the pressure put on us by the lovely Debt Collection people despite us proving we have no extra cash at the end of the month. And against the OFT's own regulations. Nice one, I guess my offer of a quid with the tag line - every little helps, didn't go down too well...

Plus Barclays charge me £212 because our benefit was underpaid and now we can't get out of the debt spiral. Neither Barlays nor the DWP wanna know about it. Screw the lot of 'em I say they just painted a huge target on themselves...

But then that's just me.

    Hi and welcome

    Good luck with this.

    There is also another thread called debtfreewannabe that may be of some use to you, as others have been in the same position as yourself.

    And if you make a complaint and they don't resolve to your satisfaction by a final decision - you should have the right to make a complaint to the financial ombudsman service.

    Fingers crossed.;)

  • The Ombudsman seems to be draggin his heels. There seems little movement and much pressure and no resolution either way... So we wait nearly 2 years since this fiasco started...

    Sorry missed the bit where you had first stated that you have this with the FOS.
    Have you requested for fast tracking by any chance due to the fact of hardship reasons, if not then let them know and ask for this, good luck.:)
