Carphone Warehouse misold contract

Hi all,

Hopefully someone can help, about 1 month ago my girlfriend took out a £20 per month contract with Carphone warehouse for the 3 network, she has since found out that carphone warehouse are going to charge her for the £35 contract which is incorrect as she did not agree to this.

She wrote and complained to Carphone warehouse and they will only offer her a cheque for £240 which they say is non-negotiable, this still does not cover £20 deal works out to be around £80 short. She is not interested in a cheaque and just either wants the contract changed back to £20 per month as agreed or just cancel it altogether since this is not what she agreed.

She has contacted offcom and other agencies but all say they cant not help since the contract is under the 3 mobile network this must be crap.

Is there anything she can do to get this resolved??

    Did she sign a contract in the store? And did that contract say £20 per month or £35 per month?
  • It was all done over the phone with the carphone sales rep, so they have a recorded call agreeing to the £20 deal, which they have sent a letter to her stating this that they agree it was for £20 but will only offer this cheaque for £240 and also she must still pay £35.

    She has just contacted 3 mobile direct they said they might be able to change this to the £20 deal if she faxes this letter to them, we'll see
  • If I was her I wouldn't be bothering to contact Three.
    It was Carphone Warehouse that mis-sold her the service NOT Three. They are just trying to pass the buck on their error.

    Call Carphone Warehouse Sales/Customer Service back and ask to speak to their manager (write down their name) and explain that she has been Mis-sold. Tell them you have a letter confirming all this but the cheque is £80 short. Tell them they either contact Three on her behalf to correct their mistake/tarrif or ask Carphone to send you an £320 Cheque and thats non-negotiable. :) Do not let them fob you off to Three.

    If they fail to either correct the Tarrif or Send the full amount of difference then contact Trading Standards and then begin a small claims case against Carphone Warehouse (plus costs for failing to honour agreement)... She will find they'll have the cheque (plus costs) before it even goes anyway near a court. ;)
  • I think were close to the stage of doing the small claims, carphone warehouse never asked her to contact 3 she just phoned them as she was getting nowere fast with anyone, and they have so far been the most helpful they said they would change it to the £20 after she faxed the evidence to them so see what happens tomorrow.

    As above, chase carphone warehouse and don't stop until you have the cheque for the full amount of the overcharge.

    If they don't play ball then take them to small claims and claim for the over charge cost plus your own time in dealing with the matter etc etc.... they will soon settle.
