Are Orange in breach of the DSR?
Hi all
Here's the scoop.
I upgraded with Orange (ordered a BlackBerry Bold but was sent a Curve). The phone was faulty (the 'N' button didn't work on the QWERTY keyboard). I sent it back (at my expense) and had to wait seven days for the phone to be back in stock before I could re-upgrade and get the Bold.
The Bold was due to be delivered to mum's address last Tuesday, but didn't. I asked to cancel as my mum had waited all day and get my PAC code. It turned up on Wednesday and my mother signed to say she was not going to accept the phone.
Orange are refusing to do this until it's back in stock.
Under the DSR, I assumed that I had seven days to cancel, as that's what the law tells me. In addition, by law, they have to provide my PAC code within three days of me asking.
Whether they've received the phone back from the courier or not is surely irrelevant? The courier's website confirms that my mother signed to decline delivery.
What I'd like to know is where do I stand? I phone Orange at least twice a day at the moment, and I'm getting no further. Bearing in mind, I've told Orange that I want to cancel my contract last Tuesday. This is now six days ago.
ALL I WANT IS TO ESCAPE ORANGE!

First of all, DSR does not always apply to upgrades - you are not taking out a new service or contract.
Having said that, the story seems quite complicated, and I'm sure someone else will be along soon to advise on the rest of it.0 -
You know what? I've just got my PAC code, so all is irrelevant now (but I can't seem to delete the post!)0

Don't delete a post just because you've solved the problem-otherwise no one can benefit from your experiences.
And all the responses will still be there regardless.No free lunch, and no free laptop
