Iphone 4 problem with Orange

Just got the Iphone 4 yesterday with Orange.

When i got home I realised that there was a problem with the camera ad it wouldn't work, kept resetting the phone when I tried to open it. I googled this and found out that it is a common(ish) problem with the Iphone 4.
Took it back to the Orange shop today and they asked if I had done a software update or factory restore, I hadn't so went home and done this with no luck. So I then phoned Orange who then put me through to their dedicated iphone dept who then put me through to Apple support.
They told me that I could either have the phone couriered back to them for repair which would take up to 12 days or pay a deposit of the amount of a new handset to them and they would courier a new handset to me and take the old one for investigation.

I phoned the Orange shop and they told me that if it were any other phone they do they could replace it there and then but because it was an Iphone they didn't have the authorisation to do this.

Not sure what my rights are here.

Can I demand an instore replacement as they sold me a duff phone ? or can I demand a full refund and just hand the phone back ?

    If you got it from a shop then the usual SoG acts apply, a guy at work had a camera problem on his IP4 but they just replaced it no questions asked, if the handset is less than 28 days, contact your local trading standards office.
  • Very strange. Legally, responsibility lies with the retailer. If it's within 28 days, they should be able to exchange it. We can at CPW, authorisation doesn't come into it. Outside of 28 days, Apple do deal with it themselves. CPW for example are accredited Nokia, LG, Samsung and Sony Ericsson repairers but with Apple products we have to send their products off to them where nine times out of ten, Apple will exchange the phone. Even if the product is outside of 28 days, I can't see why Orange can't arrange the repair for you. Have you called their head office to get a second opinion?
