what are my rights?

Bought a car from a guy that is a motor trader and has given me receipt with all the garage details on and 6 days after buying it the head gasket has blown we have phoned him and he says he doesnt know what we want him to do about the problem? i have to get to work 40 mile round trip every day and now have no vehicle so what are my rights please?

    Is it a Rover by any chance?

    As for your rights - repair although if he doesn't know what to do about the problem then refund

    Refund. VERY common problem though so don't buy another.

    Small claims court. Be reasonable with him at first though don't go in all guns blazing.

    Under the sale of goods act the seller would have to PROVE that the problem wasnt there when he sold it to you.

    I would say he would struggle to be able to prove that, therefore you would win in the small claims court.

    You MUST give him the opportunity to repair it though.

    I suspect he has tried to word the sale that its a 'trade sale' or 'no warranty implied or given' or 'sold as seen'. Irrespective as he is a dealer he has obligations under the SOGA
