I think I can agree to some extent what the tt9'ers are saying because I my self have been banned for similar reasons. Did I deserve it? 3 years later I can now say less grudgingly, yes I did. Have I learned my lesson? Yes ofc.
BUT to all the people saying anything against us. !!!!!!. You have not been in our situation so go fish elsewhere and if your not here to help then go fcuk yourself.
I understand the frustration of the bans. We paid our dues, have had embarrassing moments in courts and even socially, relied on public transport again. For these reasons and more I understand and all i can say is hang in there guys and learn for next time what to do and what not to.
One thing I can say is that the insurance companies and justice is system IS a joke! Insurance companies need to have some kind of legislation to cut down the farcical pricing of policies and don't give me crap about the its all because of the claims company that this has been increased. The government are not doing anything about it cos they get money from it at the end of the day.

Hi after reading the threads i think i should share my experience. I passed my driving test in 1988 and had a clean licence and driving history.
In March 2009 i recieved a NIp asking for information on the driver of a vehicle who had been flashed for speeding.
Being the director of a company the NIP was addressed to me so i replied by post.
The Police force who sent it said they did not recieve the form and because 28 days had passed i was taken to court for failing to supply the identity of the driver.
In court I explained the vehicle was flashed whilst I was on holiday and was not being driven by me.
the court after hearing everything convicted me for the offence and gave me 6 points and a £1100.00 fine with £600 court costs and a £15 victim surcharge.
Then in August I received a court summons for the same thing again. i had not recieved any other correspondence and when i appereed in court explained this to the magistrate who said "tough postal rule applies" and handed me a ban for 6 months another £1100.00 fine and court costs of £600 with the £15.00 surcharge.
Basicallly in 2009 i went from a clean driving licence to being banned for nothing more than a paper pushing exercise.
When the ban expired i thought that would be the end of the matter however it has transpired that because a TT99 ban stays on your licence for 5 years i am getting shafted by all the insurance compnies.
My insurance has gone up from £12500.00 a year for my fleet to £26500.00.
it has come to the point that a smart car worth £900 is costing me £2999.00 to insure TPFT. If i dont declare the conviction it is costing me £497.00 fully comp.
So basically for the next 3 years i will have to pay extortionate premiums because the law here is an !!! and is administered by the biggest !!! holes i have ever seen.
RIP OFF BRITAIN IS TOTALLY TRUE.
Only now do i realise why people drive without insurance!!!!!!!!!!!
I think its time everyone claimed for every little incident maybe then these thieves will have a taste of their own medicine.0 -
Have you tried removing yourself from the fleet and Insuring the vehicles you drive separately?
It would be sensible (Your actually required to) start keeping a record of who is driving which vehicle at any time so you can supply the information if needed in future.
Also consider making one of your employees your transport manager so
they can keep on top of it and any future problems go to them.
Are you aware you should be taking a copy driving licences and paper counterpart of all of your company vehicle drivers and drivers who use their own vehicles (And ideally their Insurance certificates) at frequent intervals eg every six months or annually0 -
We always make people book cars in and out. If they are not kept to the same vehicle.
No vehicle is to leave the premises until booked out. And no change of driver unless recorded in the book also.
Our insurance now ask us to take copies several times a year, Not just once a year as we did previously.
We must notify them if any driver has points added.
I guess they are cutting down on people abusing the system.
If we all claimed for every little incident your premium will be £100,000 +

It's not massively surprising is it? As others have already pointed out, if you run a company Fleet then the most elementary of information to glean is who is driving what and when. As you have demonstrated that you do not even apply this level of basic risk management then I'm not surprised the insurers attiude has hardened!0 -

It's to try and ensure you supply them with up to date date, but more so that as an employer you have a duty under law to ensure company vehicle drivers and even employees driving their own vehicles for your business purposes have a valid licence and are not banned.
It's technically possible that if you do not check licences and drivers using their own vehicles for business purposes. That the company directors or sole trader or if they are sensible and make an employee responsible eg transport manager could be convicted of with a similar conviction to culpable homicide if the have not been checking licences and Insurances if a driver with who is banned or whose licence is invalid causes an accident involving a death.
It's wise as well to give any of your drivers a "Drivers handbook" which outlines their duties eg ensure car is roadworthy each time they use it, path to report damage, explain how to deal with accidents, advice on safe driving etc. If you do this get each driver to sign to acknowledge receipt of the book and any updates.0 -
Seems surprising to me that directors are found personally liable in cases like this.
Actually it's more than surprising it just sound plain wrong, the legal entity that owns and is the registered keeper of our van is a limited company which doesn't have a licence so can't be given points.
The only way a director can get points is if the police can prove he personally caused or connived with the failure to identify the driver, generally this is a much harder offence to prosecute & prove which is why the police don't bother and just go for the easy fine from the company.
For a director to get personally done twice makes me think there is more to this story than we've been told0
