Nuffield Gym trying it on

I cancelled my Nuffield gym membership a year ago and today I got a letter saying I owe them money and that if I rejoined the gym they would waive the current balance. After ringing them they said they did not get the 3 letters I sent them cancelling my membership and I owe £52. If I do not rejoin the gym or pay the money they say the will pass the debt to a collection agency. i have had no letters in the past year from them asking for any money I am supposed to owe!

did you send the letter recorded delivery?
technically, if its owed, then they can claim for it but it does sound like theyre trying it on.

no didn't send recorded. Shouldn't they send me a bill for the money they say I owe before sending it to a collection agency? I don't even owe them anything I have done the years contract - just them saying I haven't cancelled0

the letter wasn't a bill. it said i owe them money and then went on to say about all there great offers and if i didn't take them up they would pass the debt to collection agency. Had no mention of how much I was supposed to owe - had to ring up
Well not really, its common sense but if they want to sell it on then they can. They could do this a day after the debt was owed if they wish. After all the debt is theirs to sell.
If you can prove you sent the letter then its just your word vs theirs, except they have a contract with terms and conditions on their side. Did you cancel in line with their terms? Ie enough notice, not just cancelling the DD.Back by no demand whatsoever.0 -
Do you have proof of posting the 3 letters? Were they sent from different areas? The gym might have an interesting time trying to convince a court that all 3 got lost in the post.0

i cancelled with enough notice they say a year later they did get anything0 -
Surely if you stopped paying a YEAR ago you'd owe them more than £52???????????????????

Why did you send three letters?
If someone was switched on enough to think they might not receive/claim to not have received the letter then surely they'd realise the solution is to send it recorded rather than send an identical letter numerous times.Bought, not Brought0
