Just out of interest - and I am not implying anything about the OP's mother - if care/mobility needs are caused because an individual is morbidly obese would they be able to put in a claim for DLA?

Yes they could because it is the care/mobilty needs that DLA are concerned with not the illness/disability/condition.
  • And of course the recent defamation against disability claimants in The Sun newspaper may have contributed somewhat. It seems disabled people are the safe prejudice.
We havent really come that far since the prince was locked in the tower. (The Lost Prince,Channel 4 documentary)

It may not have been a whistle blower. DWP have been told to save tax payers ' money and to re-investigate some claims.

Not that likely the way the investigation has been conducted,

I would agree with the 'general' that it is very likely that info has been given - probably to the Fraud Hot Line that the OP's mum, is - er shall we say - stretching the truth as regards her mobility situation.

I understand they are taking no prisoners now with fraud reports and are taking them seriously enough to launch investigations using ATOS as a reference point.
I also understand that they are making sure that they obtain reports from GP's, consultants and other healthcare professionals before they tie it all up in a neat little bow.

That way, they have pre-empted the claimant's avenues to obtain evidence for any possible appeal.

A well known, tried & tested method of 'snookering' a defence being put forward, before the result is known.

'Now where do I go to get my evidence asks the appellant?'

I like it - very professional!

My mum went abroad beginning of this yr for afew weeks - She was delayed togo inside the flight simply because the person who had access to the wheelchair was not at his place. My mum sat down at one place for about 20 mins and then that man came - she was taken in the wheelchair to the flight. A lady who cannot walk from the Airport to the flight DWP are saying she that she can walk 800 st mitres without a problem.

Within a wk higher rate entitlement to nothing which she was getting for 6 yrs - Any idea what steps I can take further?

    Thanks
    MS

Anyone can request assistance at an airport. you dont need to provide evidence of why either.

Is she in a wheelchair 24/7?
What is actually wrong with her?

Quite! I know of a 'lovely' chap who does this because it often means he jumps any queues (and he's a lazy !!!!! but that's a different story!)

It shouldn't be assumed that because a claimant can answer the door and make a cup of tea they are not entitled to DLA higher rate.

It's all about the amount of pain they endure whilst carrying out such tasks. If they are in "severe discomfort" then any activity undertaken should be regarded as being impossible for the claimant to do.

The wording on the claim form is something like "How far can you walk without severe discomfort?" and if you suffer severe discomfort with ALL walking, you can correctly answer that you are UNABLE TO WALK AT ALL WITHOUT SEVERE DISCOMFORT and thus qualify for DLA higher rate.

I understand DVLA might be looking at the cases again because of Government announcement.

My mother did not open the door or made a cup of tea etc - my brother opened the door for the DWP doctor - my brother helped my mother to come to the room and sat her down.

I'm being honest - I know allot of people lie during the application to obtain benefits - I know some people myself who claims DLA but they are fit enough - not sure how they manage to claim it.

My mother cannot walk 100 mitres - she always stays downstairs as she is unable to go upstairs on her own - she needs help when getting out of the bed.

How is it possible to obtain letter from the Birmingham Airport to say she has used a wheelchair to go abroad and to come back to UK?

What other evidence should I provide? as they already have our GPs report?

Unless it's about driving, I doubt that the DVLA are interested!

I letter of confirmation from the organisation you rented/borrowed a wheelchair from when abroad might be helpful.
