Need help Please - Comet / Broke £1220 TV

Hi all,
Going through the current motions with Comet (and Sony) to try and get my 4 year old Sony projections TV replaced or refunded. Sent a letter to comet who were straight on the phone to me saying initially that No. 1 they are not liable as they are not aware of any common fault with this model and No.2 for £99 i can get it repaired (as long as it doesn't involve changing the screen - which it wouldn't)
a day later than the original call from Comet, one of their investigation advisors advised me that a more senior manager had advised him that 'REAR PROJECTION' TV's were not covered by this flat rate £99 repair cost!!!
Then sent a request into Sony, who as expected, denied any problems existed with rear projection TV's - see here for some others experiences...
//sites.google.com/site/sonylcdrptvproblems/
consumeractiongroup.co.uk/forum/showthread.php?126253-Sony-KDFE50A12u-TV
seems i am not alone, yet sony/comet refuse to accept fault.
whats best next move for me? Small claims? if so how much does this cost - what is likelihood of success?
thanks
S.

You need to seriously consider this, under the sale of goods act 1979 the retailer can (and most likely will) issue a partial refund. This will be accounting for your usage so far.
I would expect a tv of that cost to last 5-6 years. So going on the best possible result:
£1220/6 (years) = 203.33 X 2(for the 2 years remaining) = £406.66 refund due
Worst case:
£1220/5 (years) = 244 X 1 (for the one year remaining) = £244 refund due
YOu also need to factor in that currently under the SOGA its your responsibility to prove the fault is inherent at manufacture. If theyre not agreeing with you so far, this means paying out for an independent engineers report. Of course, if your successfully you get this back but you still get very little money back.
You could continue to push for a repair but they are by no means legally obliged to (over the refund).
How did you pay out of interest?

What exactly is the fault? On a four year old TV, it would be more difficult (but by no means impossible) to prove an inherent fault.
But for the second time today, I must say - get the engineer report done, this is YOUR TV, not that of people off the internet. A website is no proof.Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
Now 20% cooler0 -
