Public sewer indemnity policy help!!!!

I have had an offer accepted on a house and the water search has picked up a public sewer within 3m of the garage. Just my luck!!
As build over consent was not seeked by the sellers the solicitor is telling us that a public sewer indemnity policy will be required. My questions are as follows:

- Are these indemnity policies worth while?
- Should I be paying for this (£275!!!!!) of the seller?
- How long do these policies last and will I be able to sell on the house with this "issue". Will I have to pay for another policy when we end up selling the house?

The seller should be paying for it.
Most indemnity policies are perpetual but cover the present market value of the property so when you sell you may have to upgrade the cover if the value has gone up in the meantime.
You will need to check with your solicitors exactly what the policy will pay out for.RICHARD WEBSTER

Richard on the same theme, we signed a build over agreement as the corner of our extension butts up against a sewer. In reality there is enough room for any required work to be done without knocking the house down, but would we be able to buy an indemnity policy to cover ourselves against this happening? We don't have any intention of moving.

I have never got involved with this particular type of policy so I am not that familiar with the details. If there is a build over agreement it may be that you cannot then get a policy but you would need to get your solicitors to go into the detailed wording of the policies that are available so see if this is the case. Also one I 've just looked at only runs for 10 years so is not that helpful for the longer term,when selling etc..RICHARD WEBSTER

I totally believe the seller should be paying for it and intend to put my foot down. Although if the policy only lasts 10 years i do worry that ill be paying the premiums for years to come!!!0 -

Google 'build over' agreements as 3m sounds too far away to be a concern...My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:
