Wentworth direct finance, taken £59 without my consent!

I applied online at Wentworth finance about 3 weeks ago having been recommened by a friend, I have a bad credit rating having just come out of uni, overdrafts and that sort of thing.
However, I remember them calling me a few days after I applied online, they wanted my bank details, and I asked "Will any money be taken off this card?"
They said that it wouldnt and that it would just be used to check my rating and if was possible for me to take the loan out. Ofcourse they said it was fine and they would send a form out to me that I would have to send back, but just logged into my online banking and £59 has been taken out my account without me sending back utility bill/pay check etc. (Going over my overdraft on that particular one as well, so going to be charged from the bank!)
Not once did I send back the forms they gave me, having looked on here I decided I would not proceed with the loan as there have been some terrible cases. Absolutely furious!
What should my next plan of action be? Get the call listened to? I have tried them about 5 times just now, says there open until 10pm 7 days a week, but each time no answer. Should I contact the financial ombudsman?

What is this upfront fee you speak off? Surely none of the other 5000 threads have had the same thing happen to them.
They could't have taken it without you giving them your long card number and 3 digits on back - did you not find this suspicious?
In the main time i recommend you contact consumer direct - they will refer it to the local trading standards.0 -

As part of our application process Wentworth Direct Finance charge a brokers fee.
Under the terms of the 1974 Consumer Credit Act when accepting fees off clients if a credit agreement does not materialise between a lender and the client within six months of the original introduction, then a full refund is due to the applicant minus a £5 admin charge. The 1974 Consumer Credit Act also states that the customer must request the refund. The customer has the right to cancel it’s application and request a refund minus the £5 admin charge providing that a credit agreement has not already been arranged between the applicant and a lender which resulted as an introduction by Wentworth Direct Finance.
In processing the customer’s applications to various lending sources Wentworth Direct Finance requires full cooperation from the applicant. Some lenders may require proof of income before credit is granted and the applicant may be asked to provide such information.

Ironically, if you Google "Wentworth direct finance" they come FIFTH in the results after four sites offering warnings to avoid them.
Struggling here to see why you went for them in the first place.

DO NOT WASTE MONEY RINGING THEM - WRITE TO THEM AND POST IT RECORDED DELIVERY
Do you really want to give them even more of your money by way of call costs???

Good points you make there and thank you, cant believe I was just an idiot! The only reason I did it is because I needed travel money for my new job in London. Going to send a letter now, what do you think I should say exactly....something along the lines of "You have unlawfully taken £59 out of my bank account with any consent etc...I would like this money back asap or I can assure you I will take the matter further and contact the Financil Ombudsmen... etc"
And very true, dont want to waste £10 on a call to them, knowing they will only put me through to another "agency" of theirs. So many complaints accross the web about these guys. We all learn from our mistake

Was there a box to tick which said something along the lines of:
"I have read and agree to the Terms and Conditions" when you made you application?
I wouldn't start saying they have acted Illegally as the Brokers Fee is clearly stated in the T&C's.
Just write to cancel as no suitable lender has been identified.
You may have to wait 6 Months though in accrdance with the T&C's.0 -
Ok, thanks, I will be sending the letter to them via recorded delivary tomorrow. I will also contact consumer direct, the financial ombudsmen and watchdog. Obviosuly I realise it wont do much, but will make me feel a heck of alot better.Target- clear £1000 student overdraft by Jan 11

wentworth loan company went and took money form my account even consent me i wrote to them to refund my money back to my account about 4months. but the money has not be refund to my account now this 14sept 2010 wentworth has gone for money again which is about 59pounds i think this time i m not goin to sit down and look at thing just like that so i need my money by the end of this week.or action must be taking.thank0

Great news, recieved a cheque from Wentworth in the post today for £59, hand written from a Lloyds account, which makes me think the company is even more dodgy. In the letter I sent via recorded delivary, as Apples stated. I threatened Wentworth that I would take legal action & contact the trading standards (in whom I lied and said a relative whom worked for them :eek:)
So happy to have recieved this back today, popping into the bank, lets just hope the cheque will clear!
If anybody ever needs any help with their refund and would like me to email them the letter template that I sent Wentworth let me no.
