Has Bluelagoon not managed to pull together this information yet?

Any news on the hundreds of proven cases yet? Just a few would do, apart from the 3 already mentioned that is.:D

Who are you asking? Bluelagoon hasn't logged into the forum in ages. Considering the way some have treated what is actually a new member, it wouldn't surprise me if he never came back.

Anyone who can give an answer.Obviously Blue lagoon would be good as he was the one(iirc) who ""offered""to provide these cases. There are lots of people who have read this thread who would like to have this settled.

Not yet, but I will do shortly - believe it or not I do have other things to do in addition to posting here and issuing parking charge tickets.

    An interesting change of tack.

I work for a company that has parking problems on its land. The parking company we employ to manage the issuing of tickets has taken more than 400 people to the Small Claims division of the County Court over the last two years (not from our land, but from all the sites they manage) and they have won every case.

Just to clarify a point, I don't work for a car park management company, but the company I work for employs one to manage its car park.

So you don't work for a parking company. But you do issue parking tickets, even though you claim that your employer uses a third party company to do it.

Are you going to come clean and admit who you really work for?

Sigh, let it go, you're quoting posts from over a month ago and bluelagoon doesn't even visit the forum any more. Who do you really work for? ;)

So you don't think it worthwhile pointing out that the stuff this guy has been saying might just have been coloured by him apparently working for a parking company, and therefore having a direct interest in misleading others reading this?

I think it was pretty obvious he had a vested interest in the fact that he said so. I think you took what, to me, was an obviously facetious comment out of context to be literal. Bluelagoon has been pretty consistent.

    I challenged bluelagoon early on:

I could understand people with an actual involvement in extorting disproportionate sums of money for overstaying by a few minutes taking the time to dredge up details of obscure judgements that aren't in the public domain, but why would you want to do that if you are who you claim to be?

    He replied:

Yes, we have engaged the services of CPS. We only have a small car park (about 25 spaces) but we have issued more than 140 tickets in the last ten weeks. We're located directly opposite a company that is very busy at the weekends and their customers think that they can park anywhere they want.

Your posting implies that I have something to do with a Pay and Display car park which is incorrect. We issue parking charge tickets to any vehicles that park on our land - be it for three minutes or three hours.

I also find the subject very interesting plus it's rather good fun replying to the nonsense that people post here as fact. It's a bit like rattling the cage of a dumb animal.

I also challenged him on this point:

Yes, that has to be a false statement, which he made in post #38. I'm pretty sure bluelagoon claimed that the charges are enforceable under contract law.
    Quote:
From Post #50: If the signs are there to be seen and a reasonable person would see and understand them – then yes, if you park on the land then the contract exists and its terms and conditions are lawful. It is possible to enter into a contract by your actions, for example, entering a car park. You see the signs and agree to the charges by parking there - this creates a contract by action.
How can a contract be formed between the company and someone who hasn't parked there and hasn't therefore seen the signs and supposedly agreed to the charges?
A false statement like that - which appears on some of these charge notices, and - according to bluelagoon - on the signs on his car park - has to be an example of these companies wilfully printing falsehoods to extort money.
But even though he posted on this thread for the next 3 weeks, he didn't reply.

Read some of this thread but not all really, i beleive this has been tested on the basis of Unfair contracts act 1977, and a sign isn't normally accepted as a contract.
One question i have is how are local council car parks any different, i recently had to pay a "fine" of £40 for one hours parking, simply forgot to put a ticket on was in a rush

Thats a whole new ball game. They have the basis of law behind them, although they have been known to make serious errors on the paperwork which renders them invalid. Visit the Consumeractiongroup and Pepioo sites for some enlightening reading.
