Buyer wants a refund......What shall I do?

    Daft question for someone who has 40+ feedback...lol...but how do I do that? I might end up giving him a call.

    Basically, he received the phone...I messaged him saying item dispatched via special delivery the day before he received it and a week later he contacts me saying the item is faulty....he damaged the phone himself somehow and now wants a refund from me....I can just tell he is not being honest and is looking for a quick way out.

    Hi, the voice of doom here again...........all this is irrelevant to the one and only logical outcome.

    Ive refunded dozens of buyers for items returned as faulty/damaged/doesnt fit/wont work when I know for sure that the item is fine but its a part of business and needs to be built into your costings.

    Please, put you effort into resolving the situation with the person you bought the item off and move on.

    £145....I didnt even make a £20 profit, I was selling for a guy who I knew and I said Ill buy it from him for £145 and sell it and the profit will be mine from the £145.

    He first wanted me to sell it for him and keep all of the cash from the sale but I had to haggle a little bit considering it was the summer holidays:rolleyes: .

    Then go back to the guy you knew and say he can have his phone back and you would like your £145 back please as the phone doesnt work.

    If I was the buyer I would be getting impatient.

    Irrespective of what you do, you have to refund him, and as KevinYork said, you will lose any claim against you, so you need to cut your losses on this one i'm afraid.

    You do not have the right without evidence to suggest your buyer has damaged the phone (that is slander, which is a criminal offence)

    Be the bigger man and understand this is how business works sometimes.

    Leave appropriate feedback to the effect "sorry phone damaged in post, full refund given"

  • Hi, looks like the buyer did not want the phone or has run out of funds and needs his/her money back. It seems a long time before reporting a faulty item back to you. Has the phone been opened and tampered with internally? It could be that the person has swapped bits over so they can get their phone working. Aslo you do not always need a reciept to get something repaired. A manufacturer can usually tell if an item is outside its warranty period by a date code on a item and so far I have never had any problems getting a second hand product that has gone faulty within the warranty period repaired for free. If you do not ask you do not get!

  • He's probably posting on another forum right now about how he got sold a broken phone and what should he do.

    His word against yours I'm afraid and if he disputes it with Ebay / Paypal he is likely to win.
  • First off state what your return policy is, if you have one, if you dont, then toy shuld not accepted the item returned but to inform him that if he belived that the item was sent to him damaged then he should have opened a dispute with either ebay or paypal first.

    But as you have accepted the return then you should refund payment minus the p&p.

    As for him winning hands down in small claims court, it is not that easy. Private sales are a minefield. If you sold the phone exaclty as described and can prove it then then you would be fine, as damage was either incurred during postage or he accindently dropped it. What you should have asked for back is the original packaging also to see what condition it was in. If damaged during postage then you could claim back from royal mail as special delivery is covered against damage.

    Ideally you need to state clearly what you return policy is, because you should never accept a return for whatever reason unless your prepaid to refund
  • Would you be able to get a hold of a battery to fit the phone from somewhere to test that it is the phone that is faulty or the battery? I am not an expert on phones so what i am saying maybe completely useless. I dropped my fone in a cup of coffee a couple of months back, i didn't turn it on for a few days. I dried it out first then assembled it. The battery worked fine for a few weeks but now the fone won't even charge. My point of this is that there was a little bit underneath where the battery sits that turned red when it was soaked. I was told this is there so that they know when someone is trying it on when customers say that it doesn't work when in fact it was there own fault as they somehow drowned it.
