How can it be mine when I sent it to him in top working order? Honestly, The phone was sealed when I got it, I only opened it to test it out because I know some buyer may say 'the seal was on so how do you know if it was working' or something similar.
I only turned it on for about 10mins, made calls and used the camera function - no problem.
I am not going £165 out of pocket....thats how much I sold it for. btw I am not giving him the postage costs which was £10, he agreed straight away and has also paid for postage for the return....doesnt that sound dodgy?
All I know I will not go £165 out of pocket.

Think you should refund....problem with on/off button 'sticking' could have meant the phone 'sticking' in the 'off' state....which it appears to be permanently now. As the buyer said originally...it's not working properly.0

The on/off button isnt even sticky though. Its still in the same condition as I sent it but now obviously the seller has done something, the phone doesnt turn on.
I dont know how much ill get if I resale, probably £50-£80...thats still over £80 loss for something which had nothing to do with me.0 -
I know its hard to accept, and you dont want to hear this, but you really have little choice.
OK the fault isnt identical to what was described but it is faulty..maybe the original fault he described has been made worse in transit back to you..you will never know and unfortunately in a case like this the benefit of the doubt will always be with the buyer.
If he took you to the small claims court he would win - no doubt.
Refund him and try and deal with your supplier re the fault. If you bought the item to resell then you are effectively a business seller and he has even more consumer rights in such circumstances.
Please try and step back from your possible monetary loss and put yourself in the buyer's shoes...what would you want as a resolution.

Assume you bought it from Comet or the like, you would be down to them like a shot asking for your money back.
You can only refund and claim off the person you bought it from. This is what happens in business.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

Of course it is your problem (assuming it has the correct IMEI number) then the problem is yours. You will need to take this on the chin. I have a shelf full of items that broke, most are pilot error or alien intevention but the customer got their money back or a replacement. You need to keep funds free to cover these eventualities.0 -
The point is I sent it to him in working condition, he obviously dropped it or has done something to make it not work. He is using the on/off button as an excuse....I know he's trying it on with me, it never left me in faulty condition, it wasnt sold it faulty condition.....I know I would like it if I received something and it didnt turn on but he is lying about the button which tells me he is lying abut the on/off problem.
If I even had the slighest of doubts that it might have been faulty before I sent it I would have refunded him.
Basically, he received the phone...I messaged him saying item dispatched via special delivery the day before he received it and a week later he contacts me saying the item is faulty....he damaged the phone himself somehow and now wants a refund from me....I can just tell he is not being honest and is looking for a quick way out.0 -
