Just wanted to sympathise with your situation - I would have thought this illegal- but I'm no expert in these matters. (And going by previous posts it appears this happens regularly) It really annoys me that these firms can treat people in this way by giving them extra stress, when all you are doing is facing up to your temporary financial difficulties and trying to organise a way forward.
It does beggar belief, that folks with with some financial hardship are treated like lepers, spoken to without respect but with distain(this is theft in my opinion). However, louts and criminals are protected by the law, with police unable to give a 'good telling off' for fear of reprisals by lawyers! Who is looking after US LOT!
I hope you can get your money back through the bank and I hope you have enough money for food etc., whilst your waiting for this to be sorted out.

Spent hours on the phone initially to carter forbes practically begging for the money back which was humiliating, then pleading with natwest to help me out with this situation.
Some total of the calls is " its your own stupid fault! "
Apparantly because cash genie is a payday loan and i electronically signed a cca with them even though I wanted a payment arrangement, once they had my details I have already given them permission in the cca to collect the amount owing.
The amount they were chasing me for was £448 the got £380 on tuesday. They did say they would accept that as full and final settlement. Too bloody right they will they wont get another penny off me!!! So i've asked a letter to be sent to me confirming this which they said they will.
I truly have learnt the hard way. Luckily my wife and I hav done some calculations and we should be ok to survive on her wages this month altough it may be very tight.
THanks for you concerns, and to anybody even thinking about paying a debt with a Debit Card DONT!!

As you've been burned once, I really don't want you to be burned twice so I'll ask you if you are really going to trust a company who have just been incredibly underhand and effectively stolen £380 of your money? :think:
Have you cancelled your debit card yet? If not do it now before they take any more because they will! It may not happen this month but they will wait until you next get paid (because you gave them this information remember) and then try again. And they will use the whole 'you gave us permission to in the credit agreement' excuse.
If you get a 'full and final' offer letter make sure you post it here (remove identifying/personal information) so the wording can be checked. These companies have a habit of offering 'full and final' deals but actually they are not (and use clever workding to ensure they are not) and they then sell on the remaining balance to another DCA who then start pursuing you for that.

Can I just say they will still take a payment from a cancelled debit card, have just tried to dispute a payment taken by Fortress for £45 (1 month loan) on a card that was cancelled 5 months ago with Lloyds TSB and they (Lloyds TSB)say that because the card was valid when I made the agreement with them and I owe them the money they cannot dispute the payment as the original CCA I signed is classed as authorising the payment:mad:

In that case the only option is to completely change banks and have your salary paid into this new account and close your old account down

Kathy when I cancelled a card with Halifax to stop a scam loans company taking money I had the girl check everything showing on Halifax's systems and then I made sure Halifax knew I was stopping the card because of fraud/theft concerns and that anything that anyone attempted to put through on that card thereafter was not authorised. They were lovely about it and assured me nothing else would be able to be taken off the card or out of my account again.I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

Really sorry this happened to you and it should be illegal! Would/could this happen if a 3rd party uses their debit card to make payments on behalf on someone?0

What about paying by credit cards? I sometimes pay my monthly payment by credit card, I've never had a problem with that.
Surely they couldn't take out money without authorisation.0 -
cant say im suprised. why else do u think they BEG u for ur card details. 'arrangements' mean nothing to them. That's why so many DCA's refuse to give out other payment details.0

Same thing has happened to us today with Castlebridge dca. After several phone calls to Santander and dca the bottom line is tough.
Have put in a complaint to OFT and Santander, no-one is ever getting my card details again.Don't Judge anyone until you've walked a mile in their shoes......Proud to be dealing with my debts - LBM 29/07/2010 = Debt at LBM £8,412.93[STRIKE]£5267.50[/STRIKE] £3740.84 left
, dealing with it one day at a time and no longer alone.
