If you have reasons for misselling then you can make a complaint BUT if you won they are allowed to use the redress to reduce the debt owing. How was it sold to your OH?0

As far as he can remeber it was just added to the account. The account was opened in 20050

He filled an application form in and at the bottom it said"Please enrol me into Capital One's Payment Protection Scheme. My OH ticked NO. I have a copy of this which Capital One sent him0

As you have good evidence of this not being wanted at the time of application and if they actually added this at that time also (and not later!!) then I would say you certainly have a good case. I would follow the guidelines on the ppi reclaiming guide http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
and do the FOS questionnaire and send it off with a copy of your application also and try to do your own personal letter from the template as it always looks better as each have different reasons for reclaiming. You then have to give the firm 8 weeks for final response in the matter and failing them upholding it you would be able to take this to FOS (although going by what you have posted you should not need to do this). ALways send your letters by recorded delivery so you have proofs. Good luck0 -
Sorry i have done the questionaire i think where but where do i find the template letters and application, also need to do a letter to Lowell Financial saying account is now in dispute.0

Hi there
So you completed the FOS questionnaire, as shown on the link Marshallka have posted? And this then goes to the ones who set up the account and mis sold.
If you do a letter, its best to write in your own words as Marshallka have said, as the FOS questionnaire is in replacement of template letters, to what I know of, the first one anyway.
Do you mean you also require a copy of your application and/or agreement?
To do this you can write to request they send you a copy of the agreement, and enclose £1 postal order or cheque payment, request they send by 12-14 days, and post by recorded delivery.
Do you have the account number to add to the letter to request for this?
If so remember to enclose this too.
Good luck.;)The one and only "Dizzy Di"

Pinkjaney, it may be a good idea to post on the debtfreewannabe thread to get some help on a dispute letter, "if your having problems with payments etc".

Hi
I see.
I am not sure on this one to be honest, you can write to explain, but there are no guarantees, but just to make you aware, if payments are owed just be careful they don't default the account.
Hopefully someone will know more of this and post up with some answers soon.;)The one and only "Dizzy Di"
