No Return = No Refund in my book.
The trouble is if he is being difficult the item WILL be damaged by the time it gets back to you.
In a case like this I would try and get the item back first, hopefully he doesn't get a tracking number and you have. Then you are in a stronger position to decide the case on its merits. My advice is do not start a fight until you have the goods back in your possession.0 -

Call his bluff - sounds like he is bullshitting you and trying to intimidate you...
Tell him/her to go for it. No one would reasonably expect you to refund without proof of damage and the goods back.

surely if its arrived damaed in the post and im assumingg this happened during posting and wasnt there before then he can claim his money off the post office if it was packaged properlyIf you want the rainbow you have to go through the rain.

If the item was damaged in the post then the seller, not the buyer, could possibly make a claim against the RM. However such a claim is not guaranteed as RM require the seller to show the packaging and to 'prove' that it was securely and properly sent.
Normal ebay practice would be for a buyer to either send photographic proof of damage to the seller to assist the seller to claim against RM, or to return the item to the seller.
