Will Argos refund?

My colleague bought a bed from Argos around end of July. A couple of days ago it broke.

Basically the bed is poorly designed, and was unstable. It's unlikely a replacement of the same bed would be any better.

It cost him £100. Do you think Argos will refund him? Also, any suggestions on what to say?

    In the first 6 months if an item breaks it is up to the retailor to prove the item wasnt faulty at the time of purchase. If they are unable to do this then it is up to the customer to decide how the situation is dealt with (repair, replace, refund etc). After 6 months it is the customers responsibility to prove it was faulty at time of purchase otherwise the retailor decides how the situation is dealt with. The exception to this is if the customer has been deemed to accept the defect with the goods - eg if you accept a discount off the price for one fault and then another developes

    From past experience with Argos returns it will certainly be easier if he has the receipt, or the delivery note with the date on it. If not no worries, the Sale of Goods Act only requires 'proof of purchase' to get a refund (and that can be a CC/Bank statement - or even a cheque stub - showing the purchase, or the email confirmation if bought online).

    Don't let him accept a replacement if he doesn't want one, he is indeed entitled to opt for a full refund as stated above.

  • He phoned Argos. They offered to exchange the bed for another one, or to get a replacement. He wasn't allowed a refund as it was after 30 days.
    Their T&Cs quote 30 days as well.

    I'm confused now:confused:

    Any ideas on why he's not allowed a refund?

    Sorry, not directed at you OP, directed at Argos. The 30 days is THEIR policy for returns, but your statutory rights are NOT affected.

    What this means is that they will offer exchanges under under their policy for up to 30 days. But your friend is NOT claiming under their store policy, he is excercising his STATUTORY RIGHT TO A REFUND (sorry to shout). As other posts have said, he has 6 months to do this and Argos cannot wriggle out of it.

    He needs to speak to someone who knows the difference between store policy and the Sale of Goods Act. If that has to be a top manager, so be it.

    beds are home delivery only, so they should have his details when they ring up

    The same happened to us. The bed was 9 mths old, ans the mattress had gone lopsided, the base had a ruddy great dip in it.


    Anyho, I no longer had the delivery note, but I emailed with teh date from a bank statement, and they immediately offered me a replacement.
    I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

    Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    After reading this, I decided to contact Argos about a DAB radio I purchased online 5 months ago that has gone faulty. I had no receipt or delivery note.

    Argos were great and will collect it in 2 days time and give me a full refund. No trouble at all.

    So thanks everyone.
  • Fabulous. Really, I think Argos should be on the Heaven Sent board. They may not be perfect, and sometimes get it wrong, but by and large, I think they're pretty darn good.

    Good news. Argos gave my friend a refund yesterday. At first the Customer Services person quoted the 30 day rule. Once my friend insisted, he spoke to his manager, then apologised and gave a refund.

  • Argos usually is refusing refunds for laptops offering new ones or repairing because as they claim laptops are excluded form refunds. Argos is breaking Sales of Goods Act 1979. The best way to claim your rights is to go to Small Claims Court. It will cost you about £60.
    Usually if laptop was bought faulty Argos have to give you refund if you reject faulty laptop and will not take new one. This issue is regulated by:
    Sales of Goods Act 1979
    The Sale and Supply of Goods to Consumers Regulations 2002 (which amends Sales of Goods Act 1979)
    derived from
    EU directive 1999/44/EC

    Do not allow them play with you. Just go to court and claim your rights.
    Do not forget take expertise form independent engineer. It will cost you from £20 to £50 but cost will be covered by Argos if they lose the case.

    Please note, you have to inform Argos about fault in your laptop within erasable time (7 days?).
