Purchased Motorbike issue - please Help!!!

I purchased a 2nd hand motorbike from a local dealer last Tuesday, traded in my old one as part exchange. Received new bike on Wednesday and until this morning everything was goign fine...
On the way to work this morning I had an issue where the bike slipped out of second gear whilst accelerating and went back into neutral; this happened on a roundabout and was quite scary but thankfully managed to get to the edge of the road and sort things out.:(
The bike is a 1999 Yamaha YZF600R (23,500 miles), I had read before purchase that there is a possible issue with second gear slipping out under acceleration; I checked this on a test ride before purchase and all seemed fine. The dealer assured me that the bike was a decent honest machine, had no reason to doubt him as he was where I purchased the machine I traded in and that was flawless.
My reading of the subject indicates that it might require a new 2nd gear to be fitted along with the selector fork(s), quite an expensive job I believe. My question is, will this be covered by any legislation so that I claim the repair off the dealer?? I have a 3 month warranty, not sure of exact details/exclusions at the moment. The bike had a full MOT done last Saturday and the certificate showed no advisories.
He also said when he delivered it on Wednesday that he had just serviced it in acordance with the service book; stamping it accordingly.
Anyhoo, I want to check that it wasnt me doing something silly before I go back there (have only done 9 miles on the bike at the moment) but basically is there any legal recourse that I can use if I have to contact the dealer to get them to pay for the repair?? I dont want to return the bike as I love it and touch wood this has been the only issue.

Make sure you're clutch is properly adjusted, and also check the gear-change linkage is set up right. If the clutch cable is too tight, it might be slipping fractionally, which would make it easy for the bike to jump out of gear at the slightest knock of the gear lever. I had issues on my Fazer 600 (1998, pretty much the same engine).Skip dipper and proud....0

i bought a sprinter van last year from trader..part exchange
2 months down the line , one of the doors wasnt closing properly-- the trader didnt make any fus about it, next day fixed0 -

The dealer didn't make me aware of this, I read the potential issue on various Yamaha owners forums as part of my investigations prior to purchasing the bike.
As said it didn't exhibit any issues during my test ride when I accelerated hard in second; the dealer mentioned that there were no known problems with the bike and that it was a genuine honest example.
Will this issue be covered by sales of goods act or similar?? Not entirely up on my legislations yet0 -
Check you paperwork 1st, have you contacted the dealer?I all have learnt is from others on many sites.
Seek legal help if unsure.

Haven't contacted him yet no, as said want to be sure that the problem is regularly occurring and that it wasn't simply my !!!! up
Haven't received the invoice yet either, he said when he delivered it that he had run out of sheets on his invoice pad and had them on order - that it would be mailed to me within the next few days. Have receipts for the card purchases though so can prove purchase if needs be. Would have thought the mechanicals such as gearbox would be covered by the warranty, not entirely sure though.
I know that if I take it back I need to give him a chance to fix the issue, not wanting a refund - I love the bike :j

Yamaha well know for iffy gear boxes, take it back it must have some sort of warranty.Nothing to see here, move along.0

Thanks, yeah I had heard that was the case! Shall see how it goes over the next week or so and then take it back. Have only had it a few days and there is a 3 month warranty - though not sure what exactly is covered :eek:0 -

Where did you read about the fault? You can't claim off the dealer if they informed you of the fault before you bought it, either verbally or in the writing. You also test drove it and it appeared OK. However, you have got a 3 month warranty and it should cover this. I'd be pursuing the warranty as the first course of action. The 2nd gear should only need replacing if its been ridden for ages like this.
A MOT doesn't examine the gearbox or have a road test so it would not be on any advisory.0
