Fireplace company unwilling to rrefund fitting costs

Options
Hi,

Just after some advice. In May I ordered a new fireplace and electric fire from a fireplace company. We asked if they could cap the gas and fit the fireplace and electric fire. They recommended a fireplace fitter and said we would need to pay the fitter directly.
Anyway we've had a nightmare with the fireplace company and the fitter. The fitter didn't cap the gas correctly so we had a gas leak and the fireplace company delivered a damaged fireplace. To cut a long story short we had 3 replacement fireplaces deleivered which were all damaged and the fittter (same guy who didn't cap the gas correctly) not turning up when he said he would. The whole epsiode has been going on since the beginning of May when we ordered it.
I recently got my my money back from the the fireplace company for the cost of the fireplace and fire but they are unwilling to give me the £150 fitting costs. I range the comsumer advice line who say I should be able to claim the £150 back through the small claims court.
How should I proceed, do you think I should write the fireplace company a letter first? if so what should I put in the letter and how long should I give the fireplace company to respond before going to the smalls claims court.

many Thanks

  • If the fireplace fitter is part of a seperate company that doesn't make the people who supplied the fireplace liable for his actions. If he is part of their company you need to pursue them, if not, you need to chase the fitter or his company directly.

    Was the fitter Gas-Safe registered?

The gas leak was a seperate issue which was sorted. I was just using it to highlight the imcompetence of the fitter.
My question is this. I've paid £150 to have fireplace fitted but because the fireplace company couldn't supply me with a non damaged fireplace so surely they should pay me back the costs of the fitting? f I hadn't bought the fireplace I would never have paid for the fitting. Consumer advice referred to it as subsequential loss.

If you are claiming it back from small courts a LBA is always a safe bet as you would need to prove you've tried to resolve it with them and that small claims is basically your last option.

£1.15 it costs for recorded delivery (unless its increased recently?)

Have you told the fire supplliers what consumer direct have said?
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
