iphone 4 data roaming charges

I appear to be in a long list of people who have switched off their data roaming and still been charged for data!

I noticed charges of over £20 for data irrespective off switching data roaming of and using just public wifi for data while in Spain.

I contacted O2 and this was their reply:

Good evening Paul

Thanks for getting in touch about the data roaming charges.

I'd like to confirm you that even if your data roaming is disabled and
you go in a free Wi-Fi zone, the iPhone will search for the signal via
3G and GPRS if the signal goes weak.

The iPhone has the facility to keep updating your received emails and
other data even when the Data roaming is switched off. This also
generates data usage and charges. Using Visual Voicemail while abroad
will also generate data charges.

Just to let you know, the following would all generate data charges
while abroad:

1. Connecting their phone to a computer or laptop in order to use the
Internet.
2. Connecting to any of the browsing icons e.g. You Tube, Google Maps
etc.
3. Selecting links (URL'S) in text messages.
4. Downloading music / videos etc.
5. Using email through their mobile.

When you're going abroad, please remove all email accounts from your
phone to avoid any charges.

Also, please note that if you activate Voicemail (901) while on roaming,
you'll incur two charges:

1) For receiving a call made to your phone
2) For an outgoing call diverted to Voicemail.

If you want to avoid such charges while in roaming, we would recommend
you to switch off voicemail and you won't be charged. To switch off
voicemail service, please dial 1760 from your phone before going abroad.

You can use the O2 Call Alert service free of charge while abroad to get
notifications about the calls you missed. To activate this service,
simply dial 1710 free of charge from your phone before going abroad.

When does data roaming switched off mean switched off?

Can anyone help with the easiest way to get O2 to accept the problem is their responsibility and the consumer should not be charged for their known problems?

    Turn Off Data Roaming
    To turn off your iPhone's data connection when the phone is roaming to save yourself those big bills, do the following:
    • Be sure you've updated to iPhone Firmware Update 1.1.1 or later
    • Tap the Settings button
    • Tap the General option
    • Tap the Network option
    • Slide the Data Roaming slider to Off
    With this setting off, you'll save yourself from big bills. If you need to use data from your iPhone while overseas, you can turn this option on, but when you're done, be sure to turn it back off to save the costs.
    iOS 4: Turn Off All Cellular Data
    In iOS 4, Apple introduced an even-more-ironclad way to avoid iPhone data roaming: you can now turn off all cellular data. That means that, with that setting on, the only way to connect to the Internet is via WiFi. To turn off cellular data:
    • Tap the Settings icon
    • Tap General
    • Tap Network
    • Slide Cellular Data to "off".
    This can work in conjunction with, or separately from, turning off data roaming. Whether you want to turn off one or both will depend on your situation.
  • Lots of people on here with the same problem, sorry to say. The latest advice seems to be to ask your network provider for the times and dates that the data was downloaded by the phone. One person on here found that when they got this information it would've been impossible for their iPhone to download any data as it was switched off and locked in a room safe. Another person found that all the data was supposedly downloaded between midnight and 2 a.m. when they were asleep in bed!

    Definitely worth getting this info from O2, I would've thought.
