DLA Renewal

I have had a renewal form for DLA. The form I have received is just like the original. When I applied I had no medical and just completed and sent the form off. I am not particulalry worried if they request a medical for the renewal.

I have read that people submit a renewal form but are then rejected DLA even though they have been receiving it.

Reading this concerns me.

My care and mobility needs have not changed and basically I will be using the same information from my original form for the renewal. I also have additional things to provide with the renewal that I did not have on the first successful first application.

How can they possibly turn my renewal down? If they did this would bring into question whether:

(a) The original DM was incompetent in granting an award and as such should I pay what I have had back

(b) The renewal form DM is incompetent

Is it a matter of course that the DWP are rejecting renewals?

I do not know whether to send a copy of my original form with my new form and state that needs have not changed and additional information is enclosed. They can then see everything.

    I have just had my renwel turned down i was on high rate mobility and care and now they have decided i should recive nothing!

    They based their dession on an ESA medicle i had 1.5 years ago! I have now learnt the importance of supplying your own medicle evidence.

    What ever you put on your claim forms you need to be able to back up what you are saying with some sort of medicle evidence, i didnt supply my own evidence and they have instead used an very old medicle which gave a very poor and unfair insight to my conditon.

    I was always under the impression they automaticaly contacted you gp and any consultants you list on the claim forms but it appears they dont always do this.

    Im very confident my gp and consultant will write good reports for me, and i see no reason why i should not have my DLA reinstated, but of course im still worrying as you never know what can happen or how long this will take.

    I strongly suggest you ask your gp to write you a report supporting your claim it really can make or brake your claim. good luck with everything

    On my renewal I went from low rate care and mobility to high mobility and middle care. So it's not always the case.

    I am not entitled to claim ESA so have had no medical from that they can refer to. Sounds best that I do not have an ESA medical.

    On my first successful form my GP wrote on part of it and I ticked the box allowing the DWP full access to my medical files.

    I have had my DLA turned down twice before, i have been receiving the middle rate care component for almost 20 years. The first time it was turned down was because my mum had just written 'no change' to all questions - this was when we found out they don't have a copy of your previous forms in front of them! So make sure any renewal you send in you put all the necessary information. And the most recent time it was just someone who is not medically minded (none of the people assessing are, i believe) and didn't see that i still needed the help.

    Both times we went to a tribunal and both times they overturned it straight away. The last time they had made their decision before i even went in the room.

    I have recently had my renewal pack through and now get the mobility (have done for the last 10 years) indefinitely and the middle rate care component indefinitely.

    If you have to go to tribunal they will stop your payments, but if the decision is overturned they will backdate the payments. As has been stated, make sure you back up everything you say. To be honest i use a letter from a doctor dated back to around 2000 which states my condition will not change, ever...if you have something like that written by a doctor it can help!

    My opinion only.

    People are being turned down at renewal and its because the rules are being stricktly followed which thay havnt been in the past, some people shouldnt have been awarded DLA/the level they were given in the past and now they will be refused.

    But there will be winners as well as losers, adhering tightly to the assessment criteria will help some claimants who have been badly treated in the past.

    The unable to walk/virtually unable to walk has been a joke for a long time as has the HRC for MH problems, the HRMC going to someone who can walk all day everyday/the HRC for someone who has been well and returned to normal life years ago but still claiming it.

    My mobility has been the same since I started claiming DLA. When I've done renewals, I've always wrote the problems I have and never "no change".

    You sure about this? I had a tribunal and my DLA wasn't stopped from the date I appealed.

  • As far as i remember yes, they did stop. But this was over 5 years ago, so may have changed.

    The reason she wrote no change was because it was the first renewal she had done and didn't know any different, her dad had also just died so she wasn't thinking straight....

    i was more putting that in the post to help other people who haven't had a renewal pack before.
