mobile phone cracked screen?

advice please.Bought a new mobile phone with my orange top up fund exactly one week ago.Three days later a black mark appeared on the screen. I discovered this was due to the screen 'cracking'. On no account have i dropped it, thrown it, stamped on it,or pressed on it in any other way. On returning to the shop they insist they will not exchange/repair or replace the phone as they "do not sell damaged items", they insist that it must have been damaged by myself....who is right?

If you can prove it is a fault in manufacturing (e.g. screws on screen screwed too tightly), Orange would need to repair. It is very difficult to prove this, though.
Consider contacting the phone manufacturer to see what they say.The quickest way to become a millionaire is start off as a billionaire and go into the airline business.

You don't need to prove that the item was inherently faulty within the first 6 months - it's worth reading information regarding the Sale of Goods Act and then returning to the store and having a discussion (Fact Sheet)0

I'd phone Orange and tell them that the handset has developed a screen fault, they'll ask you if you've damaged it, just say no, they'll then arranged a replacement, usually delivered next day0
