Ebay item not received

Hi, I've not received an item that I placed a bid on and paid for with paypal. I was told that it was posted 16/08 but as I'd not received it by the weekend I contacted the seller. I got a reply stating that they had proof of postage and would contact the post office on the Monday morning (yesterday) to find out what had happened. I did not hear anything yesterday and sent a message to the seller last night - up to know no reply recieved. Not sure what is supposed to happen next - should I ask for a refund, how soon do I open a case with ebay etc. Any advice would be greatly appreciated. Thank you.

    As it's only been 7 postal days I would at least give it a few more days before opening a dispute. I personally would give it 2 weeks. Then if the seller doesn't offer a refund open a paypal dispute (these are quicker than ebay ones). Log into paypal and go to the resolution bit and follow the instructions

    Thanks for the reply - I'll hang on a bit to see if it turns up. I'm just a bit concerned though as the seller has not bothered to send me an update or reply to my message.

    Try to communicate with the seller again. If the value is below a certain amount you could be asked to sign a form the seller will send you to confirm no package was received. The seller will be able to then make a compensation claim for his money back. I think it is 15 days that is the official amount of time before an item can be regarded as lost and a claim submitted. I would personally give it a bit more time, id check with the RM depot because sometimes the posties dont put the cards through the door for various reasons. You have plenty of time in which you could make a charge back for Item not received, I would try to communicate with the seller first, at least until 15 days have elapsed.

    It is actually 15 working days and no buyer is going to wait that long! As for signing bits of paper, that isup to the seller if they wish to do that, however a buyer can get a refund without signing anything and a seller needs to be careful they don't look like they are trying to dodge a refund as that will just end up with them being negged.

    OP when did you pay? Personally I would wait about 10 days from payment date (not posting date) and then open a basic dispute in paypal merely pointing out that your item has failed to arive. Then maybe escalate that to a full chargeback a couple of days later depending on what seller responds with.

    I wouldn't wait 15 days. That's the time limit for the seller when they can claim from RM. That's not the buyers problem. Compensation claims mean nothing to the buyer. 10 days 2 weeks is a reasonable time to wait.

    As a seller if you try and get your buyers to wait 15 days before you refund your almost guaranteeing a neg. The same if they have to open a dispute. As from October all disputes will go towards seller compliance it's a risky game to be playing.

    I had a buyer who item never arrived, I told them to wait. He did and when the 15 days were up he said it still wasnt there. I told him that I have proof of postage so will be going to the post office to let them start an investigation into the lost or stolen item and that he would get a form to sign to confirm it wasnt received.

    Got a message stating that item (magically) arrived couple of hours later. :D

    I hate being a seller on ebay, so many chancers.

    I know that everything is geared towards the buyer, but actually there may well be an onus in them to cooperate with a royal mail investigation as Royal Mail are also a prosecution authority.
  • T800 I agree, as a seller these days you don't really have many rights on eBay. I once had someone claiming the item hadn't arrived, I rang PayPal but they said a proof of postage wasn't enough to not give a refund (as you can claim back, though I'd lost my proof :( ) and you have to send things via recorded delivery so they have to sign for it. Some people use this to their advantage when buying things though. I still sell on eBay but I'm always a little cautious now.

    I do so love other sellers using recorded as it gives me a lot more sales as my postage as basic 2nd class looks so much better.

    Recorded is not suitable for paypal anymore though as it rarely gets a signature on delivery so you would still lose a paypal chargeback, and you've paid an extra 74p for the privelege.

    I have recently posted about a dozen things by recorded delivery and have online signatures for them all.

    I have had the postie push a recorded delivery letter through my door as I wasn't at home. So it would be logged online that I had signed for it, when I actually hadn't.

    A friend who lives in a block of flats, the courier on the way to her flat with another item, found a package for her at the front door, recorded delivery, just left there for her! :eek:

    You cannot trust Recorded Delivery these days. Only good for proof of posting and getting your money back.
