Well, as well as not liking it, it's not acceptable for a touchpad on a £500+ laptop to jump about and not respond properly. I am within 7 days as well (bought it last thursday)

Also, I'm not sure of any shops that carry every single laptop model in existance, and places like Currys, you can't even try the laptops out properly

Well its either faulty or not... your not really making sense on that part (they wouldnt release a laptop with a trackpad that doesnt function intentionally would they?)

Anyways return it as per their terms on the distance selling regs bearing in mind you may have to pay return delivery.

And whilst they dont have all models they usually have one in a similar or same series. I know a lot of sons these days use the dimpled trackpads as you describe, a simple test in pc world could have shown you you dont get on with them, just bear that in mind for buying your new laptop so you dont get this issue again.

I wasn't aware DSR applied to a "Collected" laptop....

Well I ordered it online, but you can pick it up from Huddersfield, and as I live near there that's what I did so I didn't have to wait for delivery. I didn't get to try out the laptop though, it was already boxed up in like a warehouse

Well I don't know, maybe they thought it was suitable for people who just browse and don't do everything fast, just moving the cursor slowly and then using the actual hard buttons, but I like to move my cursor and have it go exactly where it should and double tap, not have to mess about with it getting to the right place, and then having to tap it 4 or 5 times, and because of that, it's not practical for me, but maybe for other people it would be...

The other laptop I was considering is in PC World, so I tried that out and I did like it, but the VAIO was quite a bit cheaper with better specs and they're supposedly great quality so I thought I'd go for it.

Provided the contract was formed via distance selling then yes it does, this applies in this case as it sounds like the op paid first then collected.

Its would apply for argos however, as this is merely a reservation and the contract is formed in store where you have a chance to inspect the goods

Well, I ordered it online, but the payment didn't go through (I think it was because I used my phone and it didn't support the Visa verification thing by HSBC) so I paid on collection :o

So DSR wont apply. You will have to go down the route of their own returns (and forfeit any charges they stipulate) or try and return it under the sale of goods act as "rejecting" the goods. But i couldnt possibly comment on if this would be successful as i cant tell if its faulty, poor quality or if its jsut not for you.

I think it might be faulty, it seems like it after using my Toshiba. Sometimes it will move really fast, sometimes slow. Sometimes, while it's doing something it will stop, then appear in another place

Sometimes, when something loads it will just lock up for like half a second, or a few seconds (but that could because Windows 7 sucks and it has all the Sony bloatware on it too)

I really do think it's faulty, but I just have a strong feeling LD will look at it and say "yeah it lags but it's fine" and just charge me fees

Edit: Also, you go to scroll down a tiny bit and it will just jump down about 100 pixels

Also, it says on the email:
    • The goods must be in pristine condition (This doesn't apply to goods received as damaged). Software or warranties must not have been registered and all goods must be in their original packaging (Where original packaging was received). If the goods are not in the same condition as received, we reserve the right to either reject your return or charge you a minimum of a 15% restocking fee).
    • For laptops and desktops being sent back the Operating System must be restored back to factory settings using the restore disks. Failure to do this will result in an Administration charge of £49 (Does not apply to faulty goods).

By same condition as received, does that mean brand new unused? Also, for restored, this means I need to set up an account and stuff already, will that matter?

Well im strugling to help as you yourself cannot make your mind up, if your afraid of charges, send it in for repair and just say thats persistent but theres been an intermittent fault of it not moving at all or registering movements when your not touching it. That way you should be ok and can get the laptop you wanted with a working trackpad.

I just realised I've registered the serial number (habit of doing this stuff straight away) and I can't return it. Guess I'm stuck with a £500 paperweight :(

    Thanks for the advice though

Well no forget their terms, they mean nothing when your dealing with statutory rights, just phone and state the issues (exaggerate a little to make it easier) and say you would like a resolution as per the sale of goods act 1979 as you feel the laptop is not free from minor defects.

Those terms only apply to returning goods for the sole reason of changing your mind, as soon as faulty components come into this or the DSrs apply then everything changes.
