MyCityDeal london - service received not as described

I recently purchased a london MyCityDeal voucher for a beauty therapy treatment but when I actually received the treatment it was not as described on the voucher.
I complained to MyCityDeal/Groupon saying that the Sale of Goods Act 1979 states that an item purchased should be "as described". This means that the item I bought should be the same as any description of it. The treatment I received was not as described on their website and on the voucher, i.e. incorrectly described.
They replied "as per our terms and conditions:
5.7 RESPONSIBILITY: The Merchant, and not MyCityDeal, is:
5.7.1 the seller of the Voucher Products;
5.7.2 solely responsible for providing you with the Voucher Products and for the Voucher Products themselves; and
5.7.3 solely responsible for redeeming any Voucher you Purchase."
and said I should complain to the beauty therapy place.
I replied saying so I can order something from MyCityDeal, all in good faith, pay for it (i.e. give them my money), but in no way I am guaranteed to get what I paid for? I haven't received a response yet.
Are MyCityDeal right and can they, in effect, opt out of the 'as described' section of the Sale of Goods Act? Any advice will be gratefully received!

Well I had a problem with them a few weeks ago I bought a spa day it said any spa treatments to the value of £80 when I called the salon the woman said it was only for a facial, manicure and pedicure and I could only use it on mondays and tuesdays. So I emailed mycitydeal with no reply for about 3 days in the mean time I was a member of their facebook group so I posted on their wall that I had a problem and was dissapointed that no one had got back to me I continued to post on their wall for the 3 days until I got a response to my satisfaction.
Maybe you could try that it worked for me

That doesn't really matter if the OP read the terms and conditions because to be honest MCD has got a few deals wrong that I bought so the OP may well of read the terms and conditions but MCD or the company the offer was for could have moved the goal posts afterwards.
Like for instance I bought a hair dressing one a few weeks ago I booked in and went for it 2 weeks ago brilliant but while the lady was doing my hair she said that MCD made it for the wrong salon she has two salons and they promoted the salon that had been running for a while not the new salon she has just opened.They had given directions to the new salon but with the older salons address. But had to let it go and just not do a deal with them again. She also said that MCD sent her the information the night before the deal at gone 11pm saying this deal will be published tomorrow so not really a chance to proof read it all.
I do think however that MCD are after the money and won't give the business they are promoting chance to make sure everything is correct.
Maybe the OP should of complained whilst having the treatment but being a lady myself I don't really like complaining face to face I'd rather do it over the phone or in a email.

Thanks for your responses. I didn't complain at the time of the treatment, as Steph says above, because I don't like complaining face to face. Also, at first I was going to let it go but after talking to friends and family I felt a bit miffed about it and then after MCD's response I was really annoyed!
I didn't read the T&C's first because I assumed, wrongly, that if you paid for a deal, you would receive the deal you paid for!

I would presume that MCD would only intervene if the matter had first been addressed with the company itself - I appreciate that complaining face to face is difficult, but all you needed to do was ask someone if they can make a note that you weren't happy with the service, and they may have been able to remedy it on the day.
Plus, if you had mentioned it then at least if MCD contacted them they would be able to confirm that you weren't happy and it would give a little weight to your complaint. Have you contacted the beauty therapy place to see what they say?0 -
I have had exactly the same problem. Money went off my credit card incredibly quickly, days before I got my voucher. They supplied a set of mobile phone numbers to make bookings that had full mailboxes or were out of service. Much chasing up later, they have changed their original terms and conditions so that the offer is no use to me. I am waiting to get my money back. (this is a very short version of a very long saga!)
All in all, I think this company is completely untrustworthy & would never use them again. Don't be lured in by the cheap offers, they are not what they seem. Having looked on a number of forums, I wouldn't be surprised if they make most of their profit by taking and holding on to people's money...everywhere you find unsatisfactory service & people trying to get their money back.0 -
I've bought about 12 offers from them now and found them to be excellent, they've saved me several hundred pounds. There have been a few things I wasn't expecting, but it's more a case of not reading the voucher beforehand.
How different was the treatment as described?0
