what are my rights? iphone 3gs water damage claim!

having complained to vodafone in june i recently went 48hrs with no signal whatsoever, went in store for a sim change and phone reboot, next day went back to store as still not resolved. two weeks later after having the phone sent to an 'independant' repairer the phone has come back and claims its water damage. i asked for evidence which they claim they will not provide and i can pay £150 for a repair.....the funny thing is apart from the signal/network issue the phone is in perfect working order in store and has a full 5 bars, yet when i leave it says no service! go back to store and it works again....either my phone has great timing or there is a network fault? only one of my outer moisture detectors are triggered but im guessing this is due to moisture in the air or something, like i say its in perfect working order in store, i even rang vodafone off my phone whilst there to say this and they claim water damage can affect the signal like this yet everything else works fine....sale of goods act? not fit for purpose? or small claims court? many a web search has proven this is a common problem but i want it sorted!:(

    Lets step back a bit.

When did you get the phone, Iphones only have a 1 year warranty. If it's out of warranty and you don't have applecare then thats it, it's out of warranty and you'll have to pay for a repair.

You state you complained in June, did anything get done then?

You could try booking an appoiment at an Apple store and tking it in they tend to swap them there and then if there is a fault, if you say an intermittant fault chances are you will get a swap there and then regardess.

A water sensor can be tripped by accident and the phone still work perfectly, say you got water in the headphone socket, but normally they check more than one sensor, in case of it happening. The problem is if a phone gets wet then usually the dissolved salts in the water are left after the water evaporates and theese can cause corrosion or short circuits that can be near on imposssible to track.

However if the water tabs are showing red (see http://support.apple.com/kb/HT3302 for the locations) then there is very little you can do, your warrantys blown regardless of when it was bought. You can try and fight it but it's your word against Apple / Vodafones and the water sensors will point to you at fault.
