Cap One card - advice needed please

I basically have had this stupid card for years, I can't remember the last time I used the card as I was silly enough to leave it at its limit of £200 and pay the very minimum that I could.

Anyhow, being just under the £200 limit in Jan, I was made redundant for the third time in 3 years, lucky me!

I stopped claiming jsa in May and am self employed and employed as a home worker for a few hours a week.

I had always paid the ppi on the account and decided to put it to use. Axa this week have paid just £60- I believe this is for three full months of claiming jsa (they didn't include part months of Jan and May.

I've made payments when I could afford to, but was hoping that when the insurance paid up, the interest and charges since January would be refunded.

Silly me, they haven't done this and still expect me to pay it. The account balance is now at £380. They also lost a payment I made in January for £20 which I'm having to supply details for so they can find it.


They keep going on about an income & expenditure form that they say they never received. When I told them a month after i posted it that they should send me a new one, they didn't bother to or that got lost too.

They have called me on a daily basis asking for money to pay overdue amounts, each time me telling them their appointed insurance company is dealing with it.

It's a total utter shambles, do I really have to pay nearly £200 of charges when I had paid ppi for about 5 years to cover me if I was out of work? Knowing what I know now, I never should have paid it and never should have got the card with them in the first place.

Can anyone help as I don't know what to do, they're telling me they want £57 a month for 4 months to pay for those charges and return the account back to its £200 limit. I think I shouldn't have to....

    Whilst that is being done, I would suggest you take the time to refer to the terms of the PPI you had for details of what is covered.

    Whilst you won't be able to reclaim credit card interest charges from the card company, you may have some better luck with reclaiming any 'over limit' or late 'payment charges'.

    No you do not but you will have to treat it as a seperate thing ie treat it as a situation that you owe them £380 but you can reclaim all the charges.

    So imo I would set about reclaiming the charges straight away and see where you are once you get that back. Make a monthly payment you can afford then if they have added further charges after reclaim these aswell.
    Seems they have treated you pretty poorly, even more so considering the small balance.

    Thanks John, I shouldn't have left it for so long. I honestly haven't used the card for about 2 years, how poor is that on my behalf but also they have been equally as bad, considering the amount of money they're making out of me on such a little balance!!

    In that case it might be different.
    You could ask for a copy of the cca see if its enforceable or not however as its still a relatively small balance you still may be better to just reclaim any charges + 8% interest which will be paid against the balance then make whoever owns the debt a really low offer as full and final settlement.

    Really? During the time I was out of work I asked them for all the statements etc and they refused until the account was back to within its balance limit, I'm hoping now I've spoken to them about an arrangement to pay so perhaps they will do this and send everything over now so I can go through all the charges.

    I did a similar claim with natwest over charges before the rulings gave financial companies some kind of way out of paying them back but always read that Cap one were stubborn! I had a recent ppi claim with natwest which was painless to be honest, not like this company!!

    There are ways of legally making them provide them.

    CCA will get you a copy of the agreement, SAR will get you absolutely everything.
