Hello This week I bought online from argos, a much needed cooker, I only paid £179.99 but being a single mum I had to get the best price.
Just hours after I paid online they added a £30 off code to the cooker, I was abit anoyed and wrote to them expressing my anoyance which now I understand that life!
So I recieved my cooker yesterday. on the top of it, there was a sticker with the brand Flavel

But Ive just opened it up, and its a beko  ok I understand when theres non instock or what ever they can give you the nearest same product. So I just checked online and the cooker they've sent me by mistake is only £139.99!!!

The only diff is my beko is white!
Now id be happy to keep the beko if they give me a refund of what ive lost out. The cooker they've sent me is a sales/end of stock clearence item.
£40 is alot of money when I have 2 children and a washing machine to buy in a week.
Any ideas where I stand? Ive thrown out all the packaging.
Ive emailed them saying as above.

As you ordered online you are under protection of the Distance Selling Act which allows you 7 days to inspect the goods and decide whether or not you wish to keep them. They have to be returned as best to the standard in which they were delivered though.0

Thanks for your speedy reply
What about the packaging? Ive ripped the plasic covering apart and snapped the white polystyrin (sp) and the wooden planks are outside in the bins.
Id be happy with the cooker I just want the price difference even if it was a credit note to put towards the washing machine.
Thankyou again
Im not sure I can fight it as the one ive recieved (but in white) was £179.99 before the clearence sale which was what I paid for a flavel.
The white ones not even online to see what they used to charge, think I might try and dig out the old catalogue to have a look.0 -
You can never be penalised simply because you did not return the goods in their original packaging, although they may insist this, but it is not a requirement of the DSA.
Your best bet is to request a return of the cooker you have for which you will receive a refund of £179.99, you can then order it again off their website and apply the £30 voucher.0 -

They certainly can't give you a different product unless they ask you first.
I'd phone them and tell them that you are really annoyed that they have sent you a different product without your permission.
You can then go on to say that you will keep it as long as they reimburse your £40.000 -
Thanks alot for your help, my final question is do I lose what I paid for delivery and have to pay it again for the new one?0

You will receive the full invoice refund which includes any delivery charges if the product was not as described (being a totally different product meets this description).0 -
Thanks zandoni.
My mum's going to phone for me tomorow, she's alot better then me as I have a stutter when it comes to situations like this
Ill see what luck I get from them, I really dont want to be dealing with sending back and forth as Ive gone from march with no cooker and I just want to cook my kids a proper meal! They're only 5 and 3 and theres only so much a microwave can do0 -
Thankyou Alan if I get nowhere with phoning them and trying for a credit note I think ill send it back. £40 is £40. part of me feels like letting them off with it for the sake of it
guess ill have to weigh up whats most important
I think argos were bringing trouble from the start, the driver was mean to me lol0 -

What did the driver say?:eek:We are born wet, naked, and hungry. Then things get worse.

The white one is 179, the silver one is 139 because it is on offer. You have got the white one. Will having a Flavel sticker on the front make the same appliance any better, the Flavel and Beko are the same cooker the only difference being the sticker on the front.
That said you have the right to return under the DSR's. If you speak to them nicely they may refund the £30 voucher offer.
If you are a bit tight on cash I wouldn't buy two children this week, just get the washing machine0
