I notice the claim form bleats on about a contract between the PPC and the owners of the land, but they can only claim for a broken contract between them and you. They have not mentioned this contract, nor have you entered into one.

You should state this very clearly in your defence: "I have neither entered into, nor signed any contract with the Claimant." Therefore their claim is void. They've worded their claim very badly, so you should take advantage of this.

As for your alibi, you should get these in writing by email (ideally) or first class mail (failing that), so you may submit these in your written defence as well as in court.

my case hase been discountinued by OPC, have confirmed with the court today!!

Wonder if OPC have finally got it into their thick skulls that they don't stand a chance in court?

They have another 15 or so outstanding cases, all concerning a housing development in London call Ingress Park. The judge has decided to hear all the cases together. Are they in for a multiple thrashing?

Is it not an abuse of the court system to use it as a means of trying to frighten people into paying money? I mean threatening court in a letter is one thing, actually filing court papers, only to pull out of the case because you know you have no chance of winning is another.

I think the official term is "vexatious litigant" for that type of action.

That crossed my mind, so I find it rather annoying when PPC's legal letters accuse US of abuse of process when we don't tell them who was driving. Pot and kettle, anyone?

Just like all those unpaid CCJs the various PPCs and clamping companies have accumulated. They like dishing it out, but don't like to be on the receiving end of legal action.
