NHS / Trethowans spanked in Court

I recommend reading through the thread. It is particularly pleasing that, when certain posters here - and on ppp, in the past - made much of the vigour with which some NHS Trusts were pursuing parking charges (and how this would kill the "ignore" strategy once and for all,) when one is seen to bark its shins as Aintree Hospitals NHS Trust did today. The more so when its remembered that they have pursued matters to court before - ably abetted by Trethowans, of course.

I seriously doubt that the ppp thread was not being followed by the usual pack of trolls and it is probably therefore safe to assume that the fuller facts are now in the hands of the NHS Trust board. If they are minded ever to sanction another case then someone on that board is going to end up with egg on their face and have wasted yet more of taxpayers' money for which they should be called to account.

Couple that with the priceless quote from Trethowans' parking "whizz":
In practical terms, the effective management of the parking area coupled with the application on penalty charges usually acts as a suitable deterrant [sic]” says the law firm. “However, a landowner should be aware that if a penalty charge fee is levied and paid to the landowner by someone who has parked without authorisation, then the landowner is effectively waiving any claim that they may have to damages.

Collectively, they really do need to think whether it would be wise to run another case.

Well done to another excellent job by Alexis. ;)
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • This from a Trethowans marketing piece:

"At Trethowans we’re passionate about being a different law firm. Many clients have commented on the ‘certain type’ of personality that the firm attracts, and they’re right."

They're definitely right. Just a pity that the personality type is that of a LOSER.

Although this is a lift of the post I've added to the ppp thread it is well worth the read and its being available here is equally necessary for first time posters.

I presume the hospital trust is acting as its own PPC. If so, then, even compared to a "proper" PPC they seem very incompetent. If they a member of the BPA it might be worth forwarding that "penalty charge" document to them to show a clear breach of the guidelines.

It looks as though it's this person at Trethowans who is behind their latest fiasco. Note the term "penalty charge notices" at the bottom of the page.

She needs to get a lot better advice before proceeding with the next one. This case was a shambles from start to finish.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

As was the one shown at the start of this thread.

I sincerely hope that the normal legal teams are a lot better prepared than this lot. I suppose the difference is in the amount per hour.
