Some advise on my rights - Comet problem

    What ever Comet's T&C's are with their supplier is of no consequence to the consumer!! You could trace the cost line back even further if you wanted and go to the individual component supplier, then the cost of repair would be far, far higher then replacement!!!

    Yes but if the cost for Comet is £0 to send something back to repair then it is fair to presume that repair is a cheaper option than replacement because if they swap a faulty product for a new one and then they get the faulty product repaired and then sell it as reconditioned they will lose money compared to what selling a new one would make.

    You make an assumption that they get the repaired one back from the supplier, quite often they will only get new stock back and the supplier/manufacturer disposes of the faulty one.

    It is an assumption but a valid one and the assumption was only made on if they had replaced it with a new one for the customer which they are unlikely to as repairing it for the customer is more often than not the cheaper option.

    What on a £100 or so Blue ray player!!! On a car or large white good maybe, but for the OP I would love to see Comet prove that replacement is disproportionate to repair!! And it is after all for Comet to prove this!!

    Yes but if they don't pay for their supplier to collect and repair and send out then it won't cost anything (and this is not unusual for it to happen this way) then it is still acceptable.

    By the same token, if the supplier issues a replacement item to Comet, that would also cost them £0!! As I said, it would be for Comet to prove, not for the consumer!!

    If I were the OP I would be going back to Comet, ask them to replace the item, if they refuse I would ask them why, if as is normal with Comet, they point to their T&C's i would point out the paragraph that states "this does effect your statutory rights" and inform them this is what I am claiming under (Sale of goods act, not their T&C's). I would then ask them to provide proof that a replacement would be disproportionate to a repair. I will lay money on the fact that Comet will not be able to prove this!

    For most things, shops would usually allow you to exchange the item or give you your money back straight away. However, if the damage is minor and can be repaired easily, then the shop can insist on this as a first option.

    And always bear in mind a refund can take into account use you have had of the item and be partial. So if you got a bargain, its probably in your best interests to allow them to replace/repair.

    Absolutely, if they provide a new one to Comet then Comet would obviously pass on the new one to the customer (mainly because they won't have the old one, so what you said is just really obvious!)

    And if you told me to prove it to be honest it wouldn't be hard as has been explained in this conversation.
