i have had my bank charges refunded!!!!!

    Hi owesomuch.

    I also have a large loan with HSBC and they cannot ask you for the loan amount. The charges are unlawful and they have nothing to do with your loan account. I would recommend setting up a "parachute" account though to have your salary paid into as in rare cases they have closed the account in question. So long as this isn't your loan account you have nothing to worry about. Go for it, you'll be surprised!     Id say get on with it too

    Not many people seem to know buty I am the first person ( or one of 3 so far) that is being transferred to the Mercantile court. the end may well be nigh on this and little me might end up paying the banks costs.,

    Gert a wriggle on if you are doing it NOW

    No what this means is that the small claims court has said this needs to be heard in a higher court to make the decision once and for all as there are too many of these cases clogging up the small claims track. therefore Im going to the mercantile ( business) court, where they have to turn up to defend. if they defend and win, I pay all thier costs. If they win, there is vthe precedent and case law will say these charges are legal.

    thats basically the top & bottom of it.

    i vote you pm martin and get him to join you in court for that since it's him thats telling everyone they are unlawful and to claim them back. does he know? i'm sure he'd be very interested.

    we are all behind you and i think and hope you will come out of there singing!,
    out of interest do you think they wills ettle before the court date i mean lets face it its a huge risk if this goes against them it will become hot news and even more people will catch on to this!!!
