Defaults and Debt Collocters

Good morning all
I wonder if you can help me please?
I'm looking to reclaim some PPI from my creditors however, the accounts are in default and i'm currently making reduced payments under the advice of CCCS. Can I still claim the PPI back? I assume that if I were successful, then the money awarded would be used to pay off the debt, which would be great!
Also, some of the debts are with debt collectors (BPO Collections, Aktiv Kapital) would I make my claim to them or to the original creditor?
Thanks in advance and hello to everyone. I'm a newbie!

Hi and welcome.
As your account are with DCA etc, then the ppi is added debt to the balance which is worthless to you, so you could ask that they cancel this due to this reason, as your unable to make a claim for it in this position.
So of course the amount should reduce the balance.
If the ppi was mis sold to you, then I would give it a go.
You still pursue the bank or whoever sold and set up the policy from the start, and not the DCA, as they will not be liable for the reclaiming side of it, its the ones who sold you it in the first place.
So what you do is, complete the FOS questionnaire, these were recently issued by the financial ombudsman service (FOS), for this purpose, you send to whoever set the policy up for you and keep copies - in case you need to refer to it later on. (these questionnaires are in replacement of the first template letter)
They have 8 weeks in full to respond, they may ask for more time and give you a timescale of when you should hear of a decision.
You will find the said questionnaire, on link below, further down the page as Stage one.

Then what normally happens if your successful.
Any refund is then paid towards the debt balance of the account and anything remaining if any plus interest should be refunded directly to you.
Hope this helps and good luck.
If you have not had the chance yet, there is a debtfreewannabe thread, link below, of some that have been in the same position as yourself, its a very helpful thread, feel free to browse and post on there too.;)
