    It's been 10+ years since I set up the arrangement for my fee's so couldn't honestly recall what it stated.....I do know that if I have £40 in my paypal account when my fee's of £100 are taken then it wipes out my balance and the remaining £60 comes off my card. Not sure if this is how I set it up or whether it is all legal and above board - but it suits me....LOL

    **Wish I did only have £100 in ebay fee's each month though...LOL**

    thank you for all your replies, I decided in the end to go through with the ebay dispute, just refunding him his money wouldnt have sat well with me as I believe he is in the wrong. Even if I loose and have to pay an extra fee at least I would have given it a shot and stood up for myself. Just one thing that ive learnt is that if you dispute between yourselves and resolve it you can still refund without incurring some sort of fee. you have 7 days to respond to the other party and either party can escalate it to ebay customer support services to review the case and make a final decision, which I think you have a chance to appeal.

    The buyer is basically saying that he had to pay for it before viewing it (how? dont know final bid til after the auction) even though i said viewings and questions were welcomed - neither of these offers were taken up. when he came on the collection day, he said he could then survey it for the first time and found it was too old to dismantle, even though he started to number the panes of glass, undid some nuts and bolts and tried removing panes of glass - one of which broke.

    Now the buyer is saying they didnt break a pane of glass. i cant prove that they have, in my listing it states that buyer accepts all responsibility when dismantling but in my opinion hes using this breakage (among other things) to get out of the sale. if it goes to ebay to decide i cant claim for that breakage can i?

    Sorry I am a little confused - what extra fee are you talking about?

    Again I am not sure what fee you are referring to....if you refund off your own back or refund because you lose the dispute there is no EXTRA fee to pay?

    I would re-iterate in the dispute that the buyer attempted to dis-assemble the greenhouse, and in doing so broke a pane of glass. They came ill-equiped to assemble it, so gave up. The greenhouse has since been dis-assembled with no problems, so the buyer can either come and collect it, or accept a refund of £x, which includes a deduction of £y for the broken glass.

    Also re-iterate that the auction clearly states that all buyers are welcome to come and view it before hand, which they didn't do, and that they didn't state it was too old when they started dis-assembling it.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Just an update;

    well, case has now closed, they made a final decision in the buyers favour (no surprise really) but then 2 days later the case was closed in my favour and they said I didnt have to refund the buyer. Am slightly confused as I obviously still have the greenhouse AND their money so I emailed ebay and asked first off why they had made 2 decisions and also what I needed to do next as far as the buyers rights to collect the greenhouse. They really couldnt tell me as apparently the case was opened on ebay.com and not ebay.co.uk, so had to email .com instead to ask. Over a week later now and a second email just to make sure they got at least one of them, and they still havent gotten back to me.

    Can anyone guide me as to what to do next? I was thinking of giving buyer til the end of this weekend (as I havent heard from them and I havent emailed them either as thought it best to leave it to do through ebay) and if he doesnt collect it, then I was going to relist it and give the all the proceeds to charity. Greenhouse needs to go due to lack of space and I don't want anymore money - to be honest it was all about the principle of the matter that I carried on argueing my side of the story and if something good can come out of this then great.

    Any advice gratefully received!
