1 yr offsick now for dismissal. urgent help pls.

hi all!
ive been working for the same company for the last 5 yrs. last year, i hurt my back and gp thought it will get better with rest which didnt. to cut the story short, i been offsick for a year. after lots and lots of physiotherapy my back is now better and gp signed me to go back to work 3 months ago with no lifting. however, since i cannot go back to my previous work, redeployment was on the cards. i applied for a post to another department and went for interview but unfortunately, i was not successful. now they (work) said my case will go to hearing for dismissal. i am really at loss and desperate as i was made to believe that i can go back to work. today my union rep said we can fight for grievances which i cannot even comprehend. i am now thinking of changing my union rep as i this believe he did not do enough for me and i believe that he cannot represent to my favour. i am planning to ring the union office this week to ask if i can change my rep but is afraid of what the answer would be. i just wanted someone who i can talk with better understanding and knowledge and explain things to me more clearly...i just want my job back.
i do need help big time and will appreciate any feedbacks or comments. thank you for taking time to read my thread.

I don't really see what the rep has done wrong?
Are there any suitable available roles for you in the organisation?Gone ... or have I?0 -
You should be able to see it from the companies view, you are unable to do the job you have been hired for and even though the Dr has recommended adjustments the company do not have to make them to get you back into work and if you cannot do your job (which you can't as you can't lift) then they don't have to find a job etc (they do have to consider reasonable adjustments if you are covered by the DDA but you've not stated if you are or not but if they can show business reasons why they can't then there is not alot you can do).The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

the rep went to meetings with me but doesnt say much and seems very friendly with HR rep and kept saying i am not the only one in this situation. when i met him today, he gave me form and told to sign it w/o explaining things fully. i feel that he just wanted me to do what he ask me to. if i ask him question he becomes stroppy and was really showing it whenhe came back after photocopying my papers and told him that some of the pages were missing he said, are u telling me i lost it?? and that it in such tone and actions. i am not comfortable with the way he talk and answers to me. he also said that he will going to file my case with 2 other persons.
at the moment HR said none. but when i check the vacancies in the post, i saw 1 or 2 post. how can HR said none when in fact there is.
there are suitable role for me but i have to apply and go for interview as well which i am part of not like since i have been off for awhile i dont know what are the changes and what is going on now at work which they normally ask during interview.0 -

It sounds more like a personality clash than anything - the question remains, is there a suitable available job for you?Gone ... or have I?0 -

HR said theres none. thats why my case will go to hearing for dismissal cos the 4 weeks alloted time for redeployment is up.
but when i checked the vacancies, i found suitable role for me in another department. i have to apply and go for interview to get the post which i dont particularly like as i have been off work for more than a year and i dont have any clue about updates which they normally ask in the interview. i have also been traumatised with my previous job interview with 10 people applyingfor the same post.0 -

thanks for your reply Googlewhacker. i work in nhs as a nurse in a very demanding department and with constant lifting and i do understand i cannot go back to that but i can definitely work in a clinic which is not as physically challenging as my previous one. now, my rep has advised me to go back to my gp and ask about DDA and i cannot bear the thought of asking her as i can walk about and able to do things. but i still book an appointment to see gp and we'll see how it goes.0 -
I'm sorry Apple, get a grip on reality and stop talking about being traumatised at having to apply for a job. You can't do the job you were employed for, and therefore you need either to find another job within the organisation or be dismissed. If there are suitable job you can apply for them, nobody is just going to give you one because it is clearly not an exact match to your current job - if it was then you would also be unable to do that job too for health reasons.
I can't comment on the union rep however possibly you could consult your local branch for another viewpoint?0
