The NatWest Challenge…

Dear Mr *********

Thank you for your letter of ** August 2006 and I apologise for any dissatisfaction or upset caused by the application of charges to your account.

We believe our charges are fair, reasonable and transparent. We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff, which we are satisfied, complies with all applicable laws and regulations. We are also committed to ensure the transparency of the information that we give customers about the operation of our product.

Consequently, against the background, we must differ with the views expressed in your letter and will not be refunding any of the charges applied to your account.

I am again sorry for any inconvenience this matter has caused, and trust the above has been able to resolve the matter. If not, or if you have any further queries then please telephone me on the above telephone number and I’ll be happy to help.

If after eight weeks from the date of this letter you remain dissatisfied then you can ask the Financial Ombudsman Service to look at your case. A leaflet was sent to you on 5th September2006 explaining how the Ombudsman works and how to get in touch with them. If you need another copy of the leaflet then please let me know and I’ll send you one.

If you are happy with my letter then you do not need to do anything else. If I haven’t heard from you by 11th November 2006 I will close your file.

Well this is looking good so far, I have a habit of taking issues to the court room and giving the opposition a good kicking, although I always make sure the local press are aware of the time and date. The sum involve would not even buy a reasonable TV set, I just class it as a days holiday and relish the challenge.

    You sound confident - as if they have made a blatant error and not spotted it? I would caution about over confidence however. They only have to show that they applied the terms correctly - not that any terms weren't unfair - the Ombudsman won't look at it that deeply. What's the basis here? You don't have to go into specifics, just some outline of your position?

    Would this concern the date on which your 0% introductory interest rate expired, by any chance?
    People who don't know their rights, don't actually have those rights.

    The interest rates on credit cards are rising because of people like you.

    The banks would still make good profits on cards if there were no charges,as the interest charged is so high. However their biggest losses now stem from people going bankrupt and not repaying what they owe. That is what is sending the rates higher. Still, banks have to take some of the blame for giving more credit to people who already have lots of outstanding balances. However they much prefer people who can only just manage to pay the minimum amounts, a stheir profits grow faster. They do not like people who pay off their cards in full.

    Unfortunately with introductory offers etc banks arent making good profit on cards at all - if you look at the 1/2 year results released a few months ago for by the major banks you will see that the growth in profit for many of them in personal banking is actually around the level of inflation and therefore some are really seeing a reduction in net reduction in profits.

    Ultimately banks are PLCs and therefore the people with the top jobs have to keep their shareholders happy or they loose their jobs - most share holders will see think that growth below inflation (therefore really losses) as a bad thing

    I’m only chasing what the NatWest call a ‘late payment fee’ on a credit card.

    As I’ve stated the total amount is certainly not worth singing about and the odd £20 here and there did not cause me concern. In fact it was only when I came across this web site that I woke up and did a check on this banks antics, that I realised they were going beyond the pale.

    For instance, 18th Nov 05 (this being a Friday) I paid a cash payment over the counter, the statement due date being 19th Nov 05 (Saturday). Lo and behold, December’s statement showed a ‘late payment fee’ of £20. I’ve even found one which the stamped receipt shows payment two days before the due date!

    On doing a credit check I find that they have logged me in Aug 05 under the heading of a general code to indicate delinquency. :D

    That’s the next one I’ll be looking into with an angle via the DPA. :)

    What they did to your credit report was justified. Lenders always warn that you need to pay a few days before the due date for it to clear. Did you not bother to read that or choose to ignore it?

    Have to agree with THE BOSS here.If you pay cash into natwest for a natwest card it STILL takes 3 days to be applied to your cc account.Its not like paying cash over the counter into your bank account as that would show up instantly.

    I know this as i have a natwest cc and if i pay over the natwest counter by cash it takes 3 days to credit my cc.
    Onwards and Upwards ;)
