I agree with this just because this property is bring repossessed doesnt mean he hasn't got others. I was in court last week and the same landlord had several properties repossessed for non payment of his morgage because he had failed to re-let when tenancies finished. However he still had his family home and several other ented properties so i advised my clients to take action for breech of quiet enjoyment as they were all in fixed terms. IF he has no hard cash he does have properties to have the orders set against. Although my clients all said they would only want it attached to the house if it was his home not one of the tenanted properties0 -
Hi op, I had this exact same thing a few years back.. I called mortgage company and explained I was renting through an agency.. I had been given 2months notice though and apparently even the agency didnt know:mad:
they did try and help me relocate but in the end I went through the council rent deposit scheme and rented elsewhere.. i wish id have thought to go to court.
The house was empty for a year and a half too. Funny thing was my rent was double the price of the mortgage

Thanks everyone. I spoke to the solicitors acting on behalf of the mortgage company who advised me 'off the record' to look for somewhere else as he thought this is one that would definitely get a PO based on the fact that they have received no contact from my landlord and no mortgage payments since at least May (his records only went back that far). I have tried calling and leaving messages for my landlord but no reply. SO i have stopped paying my rent while I find someehere else. Also my despoit is in a protection scheme.

Definately do not pay rent to your LL - it may be that you should be paying the mortgage lender instead. Set the rent money aside in a separate account so you have it if/when it becomes clear who you should pay.
Do not believe anything your LL says (assuming you succeed in making contact). He may give all sorts of assurances in order for you to pay rent to him....which will not go towards his mortgage and may well not be due to him.
Go to the court hearing. Take a (very) brief written submission in case the judge does not let you speak. At least you can hand it over together with a copy of your tenancy agreement. Include facts about your vulnerability (young children etc) but keep it short.
Meanwhile start looking for a new place just in case.0
