CSA Payments stop at 19?
Comments

For CSA purposes, the liability ends at 19 - end of story - yes they will tell you it is payable as long as Child Benefit is being paid, but this is rubbish - sure others will be along to give the specific CSA Law quotes you may need to defend this.
But definitely at 19 CSA Liability ends, do not be fobbed off with lies. If they try and get you to cough up after this, appeal, and take this further0 -
It's soooo confusing isn't it!!
Speaking to the CSA last week they told my OH he is liable for child
This can be one of the problems when dealing with the CSA.
You'd be much better off communicating with them in writing only, keeping copies of everything sent & received & send any document by recorded delivery at the very least.
They will tell you any old rubbish over the phone as they can easily deny that the conversation ever took place.
For the purpose of this thread, liability for child maintenance via the CSA definitely ends on the qualifying child's 19th birthday even though child benefit may be payable up until they're 20.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!)
CSA case closed on 02/09/10 :beer::beer:0 -
That one annoys me too lol.
I'm all for maintaining the child. but when a child is eligible to Vote and drink in pubs while at the same time being in reciept of child maintenance and child benefit thats just very wrong.
children must be maintained, adults should maintain themselves. Sadly some pwc are getting such huge lump sums of child maintenance eg 600 pounds and upwards that they can ill afford their child to get their own job as they will lose a huge portion of their income so this will push some to keep their 'kidult' in further education. For this reason I hope that this 'payable until 19' never turns into payable until the child leaves education whenever that may be, otherwise we may see kids that never leave further education lol:D:tongue: wouldnt be funny really would it.0 -

It is not only maintenance it is things like tax credits. My 17 year old DSS has just been uprooted 400 miles to move in with us as tax credits and maintenance were due to stop so mum threw him out. He had wanted to move here last year to go to college and she stopped him as she said she couldn't afford to lose the benefits + maintenance.
Just waiting to hear if he has got into college...will be non-advanced course (doesn't have the grades for anything higher) so we have put in claim for CB a month ago (mum of course is still claiming everything and not offered 1p - currently away on holiday) hubby currently on ESA....going to be an interesting time coming up0 -

lol If he does get into college and CHB is re instated be sure and put in a claim for HIS child maintenance from HIS mother she will be more than willing to contribute:D not. seriously though you should get CM from her if he does go back to college. You paid your share when the boot was on the other foot.
Yes hadnt thought of that, its more than just the CM you can claim while child is in education like the tax credits etc the whole lot dries up as soon as the child leaves education:eek:0 -
I've read through this and most other threads, but can't seem to get answers to my particular problem.
I paid CM for my Son from age of 4 to 16 (private agreement), until he left school in June 2009 and went to college in Sept 2009. He then left college as he didn't like it after 4 weeks. As his mother was giving him all the £75 a week CM he didn't "need" an education or job. So to put a stop to this I stopped paying CM (in accordance with CSA rules) . His mother in turn stopped paying him as she couldn't afford to. After several job attempts (sacked and walked out) he eventually got a temp job with his Aunties firm in London on £300 a week June 2010. He also lived with her free of charge. He has been offered a full time contract with the firm but has told his mother that he wants to come home from London (back to Cardiff) so he can go to college again and get qualifications. Personally I think he's just work shy and missing his mates. He also don't know what course to go on !
My big question is - after leaving education at 16, being an ADULT for a year and deciding to return to college at aged 17, is he then classed as a CHILD again in the eyes of CSA, CM and Child Benefits ??
I know they say up until aged 19, but do they allow for 'breaks' in these rules? It's as though he went from Child, to Adult, then back to Child again !!
Thanks for advice in advance0 -

Does anyone have any legal back-up for this? My partner is in this situation now with his daughter due to turn 19 in September, has been told that as long as CB is being received CM will continue. We believed it only to be to 19th birthday but 2008 Child Support law states child is up until 20 if in full time non advanced education (as per CB). Many thanks for any help.0 -

We spoke to CSA yesterday as OH ex (PWC) has started a new claim for their son. He is 18 and now in full time non-advanced education (has been for the last 2 years). The CSA told us CM would definitely stop on his 19th birthday which is in December. To be honest I don't know what to believe, I have read and been told so many conflicting stories but would also be interested if anyone had any legal back-up.If life gives you lemons, make lemonade.;)0 -

He's 17 and going to be in full-time education again so yes there will be a child maintenance liability.0 -
I agree that it is very confusing about when child maintenance liability stops. As the CSA website states that liability stops when the “child” reaches 19 I will ensure that our direct debit is cancelled.
Just another 12 (and a bit) years to go!0
